Definition

The Enforcement, Potentially Responsible Party - Specific (NP) file is opened when the first enforcement letter is sent out, and is closed when cost recovery is complete.  A potentially  responsible party (PRP) is defined by CERCLA as an owner/operator, transporter, or generator. This file includes individual PRP correspondence to and from EPA enforcement or technical staff specifically regarding liability and viability issues, including access negotiations with the individual PRP.

SDMS Keyword Description

34.01 Driver Ticket
This is the document the truck driver keeps to track the movement of goods from one point to another. These often serve as a backup to an invoice and may note the amount and destination of the goods.

34.02 Invoice
This is a bill or itemized list of goods or services specifying the price and terms of sale.  These could be invoices generated by the PRP or received by the PRP.

34.03 Manifest
This is a document that tracks the movement of goods from one point to another.  This may be a chain of custody form or other evidence of the movement or changes in possession of hazardous materials.

34.04 Bill of Lading
This is a receipt listing materials or goods shipped that is signed by an agent of the owner or issued by a common carrier.

34.05 Waybill
A document prepared by the carrier of a shipment of goods that contain details of the shipment, route and charges.

34.06 Weight Ticket
This is a ticket specifying the weight of goods transported.  The weight can be taken at the beginning and/or end of the route.

34.07 Contract
This is a  binding agreement between the PRP and another party for goods or services. Can include Bill of Sale.

34.08 Tax Return
This is a Federal or state tax return for the PRP and could be for income, sales, or other type of tax.

34.09 Financial Statement
These are documents related to the financial worth of the PRP.  These could include annual reports, 10-K reports, bank statements, bankruptcy papers, etc.

34.10 Employee Information
These are documents related to personnel employed by the PRP, including subcontractors.  These documents may include time sheets, work schedules, health records, payroll records, etc.
