Definition

The Deletion  file is opened after the final close-out report is accepted, and is closed with the Deletion Docket. This file represents documentation of activities to remove a site from the National Priorities List (NPL) after remedy criteria have been satisfied.  The U.S. Environmental Protection Agency (EPA) may delete a final NPL site if it determines that mo further response is required to protect human health or the environment.  Under Section 300.425 (e) of the National Oil and Hazardous Substances Pollution Contingency Plan (55 Federal Register 8845, March 8, 1990), a site may be deleted where no further response is appropriate if the EPA determines that one of the following criteria has been met:

  1. The EPA, in conjunction with the State, has determined that responsible or other parties have implemented all appropriate response action required.
  2. The EPA, in consultation with the State, has determined that all appropriate Superfund-financed responses under Comprehensive Environmental Response, Compensation, and Liability Act  (CERCLA) have been implemented and that no further response by responsible parties is appropriate.
  3. A Remedial Investigation study has shown that the release poses no significant threat to public health or the environment and, therefore, remedial measures are not appropriate.

Sites that have been deleted from the NPL remain eligible for further Superfund-financed remedial action in the unlikely event that conditions in the future warrant such action.  Partial deletions can also be conducted at NPL sites.

26.01   Deletion Package
This is a package of documentation supporting the decision to delete the site from the NPL.  This is similar to the Administrative Record (AR) and includes public comments and a responsiveness summary.

26.02  Deletion Docket Index
This is the index to the Deletion Docket.  It is a part of the Deletion Docket, but also a separate paper copy of the index is maintained in the file if the AR is on microfilm.

26.03  Sign Off Sheet
The  Remedial Project Manager (RPM), legal counsel, and others concur that the Deletion Package is complete.

26.04  State Letter of Concurrence
This is a letter from the state concurring that the site no longer poses a threat to human health or the environment.

26.05  Notice of Intent to Delete
This is a letter from the EPA Regional Administrator, reviewed by EPA Headquarters, of the intent to delete the site.  This letter is published in the Federal Register, and invites public comment prior to the final ruling to delete the site.

26.06  Notice of Deletion in Federal Register
This is a copy of the Federal Register notice when the final ruling is made to delete the site from the NPL.  This is usually published in the Federal Register as a part of a routine NPL update.

26.07  Repository Receipt Letter / Acknowledgment Receipt
This letter / form accompanies any Administrative Record (AR) that is submitted to a site repository by the EPA. Upon receipt of the AR, the repository designee acknowledges the shipment by signing the form. The signed form is then returned to the EPA.

26.08  General Correspondence
Any correspondence including letters, memoranda, notes, and record of communications generated or received by the EPA.
