Definition

These are all trustee reports and correspondence that are not confidential in nature.  These documents are related to the Natural Resource Trustee (NRT) and their involvement during either the Remedial or Removal phase.  This could include the selection and notification of the NRT, the release by the NRT, and any other correspondence between the U.S. Environmental Protection Agency (EPA) and the NRT.  The NRT is concerned with natural resources such as land, fish, wildlife, biota, air, water, groundwater, and drinking water supplies,  not human health issues.  Depending on the type of site,  the NRT could be the National Oceanic and Atmospheric Administration (NOAA), Department of Interior (DOI), Department of Defense (DOD), Department of Agriculture (DOA), a state agency, or Indian tribe.

18.01 Selection and Notification of the Natural Resource Trustee
CERCLA Section 104(b)(2) requires EPA to promptly notify NRT of the potential for injuries resulting from releases under investigation.  Notification should be in the form of a letter indicating what activity is taking place or what product is available.  It could include copies of relevant document for review, an invitation to attend a meeting, or a request for specific action.

18.02 Release by the Natural Resource Trustee
Correspondence generated from the NRT that indicates that there is no immediate or imminent threat to the natural resources identified at a site.

18.03 General Correspondence
Any correspondence including letters, memoranda, notes, and ROCs generated or received by EPA related to the NRT and negotiations with the PRP(s).  The NRT can be a party to any negotiations.  The NRT is concerned with environmental issues not human health issues.  Depending on the type of site the NRT could be NOAA, DOI, DOA, DOD, or a state agency.

18.04 Preliminary Natural Resource Survey (PNRS)
A PNRS consists of a site survey and a brief report identifying the natural resources, habitat types, endangered or threatened species, and any potential adverse effects or injury to trust resources.  The PNRS, can be funded by the EPA, are a low-cost screening tool used to determine if trust resources are involved at a site.  It may be conducted at any stage of the remedial process, from pre-listing to pre-Record of Decision (ROD).

18.05 Natural Resource Damage Assessment  (NRDA)
If remedial actions are judge insufficient to protect and restore natural resources injured by releases from a Superfund site, or if the use of a natural resource is lost or curtailed, NRT may seek to collect damages from responsible parties.
