Advisory Board

The Advisory Board on Radiation and Worker Health was appointed by the President to advise the Department of Health and Human Services on its activities under The Act. The Act specified that the Board will include a balance of perspectives from scientists, physicians, and workers.

Advisory Board Charter

Purpose

The President is authorized by Public Law 106-398 to carry out the Energy Employees Occupational Illness Compensation Program Act of 2000. Since World War II, many men and women have served in building the Nation's nuclear defense and, in the course of this work, have been exposed to beryllium, ionizing radiation, and other hazards unique to nuclear weapons production and testing. The purpose of the compensation program is to provide for timely, uniform, and adequate compensation of covered employees and, where applicable, survivors of such employees, suffering from illnesses incurred by such employees in the performance of duty for the Department of Energy (DOE) and certain of its contractors and subcontractors.

The Secretaries of Energy, Health and Human Services, and Labor share responsibilities for administering the compensation program. Section 3624 of Public Law 106-398 authorizes the President to establish and appoint an Advisory Board on Radiation and Worker Health, and by Executive Order 13179, the President has designated responsibility of the Advisory Board to the Secretary of Health and Human Services (HHS).

Authority

Executive Order 13179, dated December 7, 2000, and Public Law 106-398, Section 3624(a)(1). The Board is governed by the provisions of Public Law 92-463, as amended (5 U.S.C. App. 2), which sets forth standards for the formation and use of advisory committees.

Function

The Advisory Board on Radiation and Worker Health shall (a) advise the Secretary, HHS, on the development of guidelines under section 2(b)(i) of Executive Order 13179; (b) advise the Secretary, HHS, on the scientific validity and quality of dose reconstruction efforts performed for this Program; and (c) upon request by the Secretary, HHS, advise the Secretary on whether there is a class of employees at any DOE facility who were exposed to radiation but for whom it is not feasible to estimate their radiation dose, and on whether there is reasonable likelihood that such radiation doses may have endangered the health of members of the class.

Structure

The Advisory Board shall consist of no more than 20 public members to be appointed by the President. Members shall include affected workers and their representatives, and representatives from scientific and medical communities. The President shall designate a Chair for the Board from among its members.

Members shall be invited to serve for overlapping terms of up to four years, except that any member appointed to fill a vacancy for an unexpired term shall be appointed for the remainder of that term. Terms of more than two years are contingent upon the renewal of the Board by appropriate action prior to its termination.

Subcommittees composed of members of the parent committee may be established from time to time. The Department Committee Management Officer will be notified upon establishment of each subcommittee, and will be provided information on its name, membership, functions, and estimated frequency of meetings.

The Department of Health and Human Services shall provide administrative services, funds, facilities, staff, and other necessary support services, and perform the administrative functions of the President under the Federal Advisory Committee Act, as amended (5 U.S.C. App. 2), with respect to the Advisory Board.

Meetings

The Advisory Board meets approximately seven times per year. The frequency of meetings shall be determined by the National Institute for Occupational Safety and Health, Centers for Disease Control and Prevention, based on agency needs. The Designated Federal Official shall determine and approve the agenda for the meetings in consultation with the Chair. A government official shall be present at all meetings.

Meetings shall be open to the public except as determined otherwise by the Secretary, HHS, or other official to whom the authority has been delegated; notice of all meetings shall be given to the public.

Meetings shall be conducted, and records of the proceedings kept, as required by applicable laws and Departmental regulations.

Compensation

Members who are not full-time Federal employees shall be paid at the rate of $250 per day, or at the rate of $31.25 per hour, as determined by the agency, but not to exceed $250 per day; plus per diem and travel expenses in accordance with Standard Government Travel Regulations.

Annual Cost Estimate

Estimated annual cost for operating the Board, including compensation and travel expenses for members, but excluding staff support, is $4,388,661. Estimate of annual person-years of staff support required is 3.0, at an estimated annual cost of $524,564.

Reports

In the event a portion of a meeting is closed to the public, a report shall be prepared annually and shall contain, at a minimum, a list of members and their business addresses; the Board's functions, dates, and places of meetings; and a summary of Board activities and recommendation made during the fiscal year. A copy of the report shall be provided to the Department Committee Management Officer.

Termination Date

Unless renewed by appropriate action prior to its expiration, the Advisory Board on Radiation and Worker Health will terminate on August 3, 2009.

Information Regarding the Subcommittee for Dose Reconstruction Reviews

Discussion

The Advisory Board on Radiation and Worker Health has a need to establish the Subcommittee for Dose Reconstruction Reviews to facilitate the work of advising the Secretary of Health and Human Services and in assisting in the performance of the Advisory Board on Radiation and Worker Health's statutory requirement to "very a reasonable sample" of estimated radiation doses for "scientific validity and quality" by advising and reporting to the Board according to the requirements of HHS and this memo.

The Subcommittee for Dose Reconstruction Reviews (hereinafter referred to as the "Subcommittee") will consist of a minimum of a chair, plus three members and the Designated Federal Official (DFO) of the ABRWH (hereinafter referred to as the "Board"). The DFO may appoint an Executive Secretary to serve in his place at subcommittee meetings, as needed. The membership shall be as specified on the attached roster and is intended to reflect an appropriate balance of Board perspectives. Members will be appointed or replaced from time to time as deemed necessary by the Board Chair. Conflict of interest requirements shall apply to all Board members involved in conducting Subcommittee activities.

The Subcommittee will be responsible for coordinating all of the detailed work associated with the Board's task of reviewing individual dose reconstructions. The Board is currently reviewing sixty such individual dose reconstructions per year. This coordination activity involves a significant amount of interaction between the Board's contractor and the agency doing the dose reconstructions, NIOSH, as well as a significant amount of record keeping relative to interactions between those entities. It would not be an efficient use of the Board's time to have the entire Board undertake this detailed work.

Function

The subcommittee is charged to perform the following tasks related to dose reconstruction and reviews.

  1. Review, and recommended for Board action, audit contractor procedures (including revisions) related to dose reconstruction as appropriate.

  2. Clarify Board intent regarding technical scope of dose reconstruction tasks assigned to the audit contractor.

  3. Select cases for individual dose reconstruction review consistent with Board procedures, taking into consideration conflict of interest matters.

  4. Assign cases for individual reviews to Board "review panels" (taking into account Board members' conflict of interest standing, and ensuring a balance of scientific, medical, and worker perspectives).

  5. Compile the review panels' recommendations/findings (including dose reconstruction review summary reports) for submission the Board.

  6. Review correspondence to the Board related to dose reconstruction reviews, and prepare responses for the Board Chair's signature in accordance with Board procedures.

  7. Review findings of the Board's audit contractor regarding dose reconstruction cases.

Structure

The subcommittee is subject to Federal Advisory Committee Act (FACA) requirements, including open meetings and appropriate announcements in the Federal Register. The subcommittee may meet in closed session, in accordance with the same FACA procedures that apply to the Board itself. The subcommittee will take direction from, and will report back to, the full board for consideration and appropriate action on all matters.

Frequency of Meetings

The subcommittee will meet approximately 12 times per year with additional meetings on an as-needed basis. Meetings may be called by the Designated Federal Official with the concurrence of the Board Chair or the Subcommittee Chair.

      Dr. Paul Ziemer is Professor Emeritus and former Head of the School of Health Sciences at Purdue University in West Lafayette, Indiana. From 1990 to 1993, Dr. Ziemer served as the Assistant Secretary of Energy for Environment, Safety, and Health during the Bush Administration. From 1995-2001, Dr. Ziemer was a consultant for the Advanced Technologies and Laboratories, Inc., and served as Chairman of the Board from 1999-2001. He earlier served as a health physicist at the Oak Ridge National Laboratory, a Radiological Physics Fellow at Vanderbilt University, and a physicist at the U.S. Naval Research Laboratory in Washington, D.C. He is a Certified Health Physicist and has been President of the Health Physics Society and of the American Academy of Health Physics. He has also served a term as a member of the American Board of Health Physics. Dr. Ziemer currently serves on the Board of Directors of the Radiation Effects Research Foundation (Hiroshima, Japan) and as a member of the Nuclear and Radiation Studies Board of the National Academy of Sciences.

In 1994, Ms. Beach became involved in the worker trainer worker program instructing and developing Health and Safety classes. Ms. Beach currently works for CH2M Hill in the Tank Farms waste operations group and is a member of the United Steel Workers Union Local 12-369.

      Mr. Clawson has been a Senior Operator in the Spent Nuclear fuels program at the Idaho National Laboratory since 1989. He has been involved in the shipping and receiving of the Nuclear Naval fuels, the recovery and storage of the Three Mile Island fuel, and received and stored Foreign Research Reactor fuels, as well as numerous other types of nuclear fuels. He also serves as the Nuclear Material Custodian. Mr. Clawson is involved in the troubleshooting and problem solving of daily problems and resolution of fuel handling as well as the design and fabrication of tools for the ongoing inventory of the fuels. He is a member as well as holding several offices in the United Steelworkers Union Local 8-652. Mr. Clawson was the former Secretary-Treasurer of the Atomic Energy Workers Council.

His experience includes working in the Dispatching Department as a Parts Dispatcher and Procedure Writer; Senior Engineering Assistant in the Product Engineering Department, working in the Livermore Special Projects Pre-Production Group; Engineering Technologist in the Product Engineering and Scheduling Division, working with the Los Alamos Special Projects Group; Staff Engineer/Engineer II in the Product Engineering Department, Los Alamos Special Projects and Nuclear Device Group; Group Leader, Lawrence Livermore National Laboratory Weapons Dismantlement and Nuclear Device Group, Program Management Department. Mr. Presley served as the Protocol Officer, managing activities associated with special visits and tours for the Y-12 Complex, Oak Ridge National Laboratory, East Tennessee Technology Park, Lockheed Martin Energy Systems Executive Offices, National Nuclear Security Agency's Y-12 Operations Office, DOE-Oak Ridge Operations Offices, and DOE-Headquarters Offices in Washington, D.C. Special assignments included working with the Advanced Strategic Computer Initiative Team, the Department of Energy and the Department of Justice as a Subject Matter Expert. Mr. Presley retired from BWXT Y-12, L.L.C. on December 31, 2002.

      Mr. Schofield worked for Los Alamos National Laboratory for twenty one years. He has extensive experience in handling and processing of plutonium and americium. Some of the areas of actinide chemistry and processing include: 1) making fuel and fuel pins for the FFTF program using plutonium, uranium, and thorium, 2) hydrogen fluoride reduction of Pu O2, direct oxide reduction, americium extraction, and recovery of Pu metal. Mr. Schofield spent the last five years as an Operations Center Specialist , running and monitoring all systems at the (TA-55) plutonium facility. He has been on medical disability since 1996. He has since worked as a volunteer with the Los Alamos Project on Worker Safety.

  • Work Group on Nevada Test Site, Site Profile

    The Nevada Test Site (NTS) Site Profile Working Group was formed in the Spring of 2006. The Working Group was formed to review the NTS Site Profile document for accuracy and authenticity. In January, 2008, the Board tasked the WG with reviewing the petition from NTS for adding a class to the Special Exposure Cohort. The WG is responsible for reviewing the NIOSH Evaluation Report (ER), the SC&A review of the ER, reviewing the SC&A Site Profile Review, and for tracking the resolution process for SC&A findings and NIOSH responses. The WG may recommend to the Board, changes in the site profile as appropriate. The WG should also strive to develop recommendations to the Board on adding one or more classes to the SEC.

  • Work Group on Savannah River Site, Site Profile

    This Work Group is responsible for a review of the Savannah River Site Profile (as revised) and a review of the Site Profile by the Board's contractor (SC&A). The Work Group shall consider issues identified by SC&A concerning the site profile and shall assist NIOSH and SC&A in the resolution of such issues. The Work Group may recommend to the Board changes in the site profile as appropriate. The Work Group is also responsible for a review of SEC petitions from Savannah River Site petitioners, the resultant SEC Petition Evaluations from NIOSH, and any SC&A reviews of the SEC Petitions and NIOSH Petition Evaluations. The Work Group shall assist NIOSH and SC&A in the resolution of issues concerning the petitions and shall strive to develop recommendations to the Board concerning the addition of classes of employees at Savannah River Site to the SEC.

  • Work Group on SEC Issues (including the 250 day issue)

    This Work Group has two primary responsibilities: 1) To serve as a review body for SEC petitions that result from NIOSH determining that it is unable to reconstruct dose for one or more individuals at a given site (83.14 SEC petition process); 2) To consider potential conditions under which significant personnel exposures might occur (in addition to criticality accidents) in short periods of time (less than 250 days) resulting in health effects. In the case of specific 83.14 petitions, the WG may make a recommendation to the Board either in support of the NIOSH recommendation to add a class to the SEC, or in opposition to such. In the case of the 250 day issue, the WG should strive to develop a position paper that can be adopted by the Board. In addition, this WG is also responsible for reviewing the Dow-Madison SEC petition and related documents, and developing a recommendation for the Board.

  • Work Group on TBD 6000/6001, Appendix BB

    This Work Group is responsible for reviewing the specified Technical Bases Documents (TBDs), as well as the Appendices that apply to specific work sites. They will also review any reports developed by the Board's contractor (SC&A) pertaining to these TBDs and the appendices, and will assist NIOSH and SC&A in resolving issues that arise through the review process. The initial focus of the WG will be on Appendix BB of TBD 6000 dealing with General Steel Industries. The WG will make recommendations to the Board in cases where Appendices involve sites with SEC petitions.

  • Work Group on the Idaho National Laboratory

    This Work Group is responsible for a review of the Idaho National Laboratory Site Profile and a review of the Site Profile by the Board's contractor (SC&A).   • Work Group on the Mound Plant

    This Work Group is responsible for reviewing the SEC petition from the Mound petitioners, reviewing the NIOSH Evaluation Report of the petition, considering issues raised by the Board's contractor (SC&A), and for assisting NIOSH and SC&A in the resolution of such issues. The Work Group must independently evaluate the integrity and completeness of the data upon which dose reconstructions are based. The WG will consider the assumptions and judgments of historical facts provided in the Evaluation Report and develop appropriate recommendations for the Board's consideration. The WG will also consider any reviews provided by SC&A regarding the petition, and will use a deliberative process to narrow the scope of the SEC important issues and questions. The WG should strive to develop a recommendation to the Board on adding a class to the SEC.

  • Work Group on the Use of Surrogate Data

    This Work Group will consider the conditions under which "surrogate" data can be used as a valid substitute for actual data for a given site. The WG will seek to establish the type and importance of various parameters (e.g., type of nuclide, amounts of material, chemical and physical forms, processes, working conditions, and other such parameters) that impact on worker dose, and will consider the extent to which such parameters at one site may apply to other sites. The WG may also consider the extent to which theoretical considerations can be properly used to bound dosed in the absence of actual workplace measurements. The WG should strive to develop a policy recommendation that can be adopted by the Board regarding the use of surrogate data. This WG was asked to consider the application of surrogate data criteria to the Texas Chemical site in relation to the SEC petition for that facility.

  • Work Group on Worker Outreach

    This Work Group will monitor the NIOSH Worker Outreach program and evaluate its effectiveness. To do so, WG members will attend outreach meetings as appropriate, review minutes and related documents that are generated at such meetings, and talk to workers and other participants when necessary. The WG should consider developing a formal assessment instrument (such as a follow-up questionnaire). The WG should report its findings to the Board from time to time, and make recommendations to the Board as it deems appropriate.

  • Work Group Procedures Review

    This WG is responsible for reviewing the outcomes of SC&A Task 3 and related assignments, which are the review of all NIOSH/OCAS and ORAU procedures used in the dose reconstruction process. The SC&A findings shall be used to establish a findings matrix, and the WG will work with NIOSH and SC&A to bring each finding or issue to some type of mutually satisfactory closure. The WG should develop one or more reports for the Board, to advise the Secretary on the scientific validity and appropriateness of the procedures used by NIOSH and ORAU for dose reconstruction and related activities.

  • Work Group to Review SEC Petitions that Did Not Qualify for Evaluation

    (Task completed on May 2, 2007)

    The charge of this Working Group (WG) was to review disqualified special exposure cohort petitions and the process followed by NIOSH and the rationale for petition disqualification. The conclusions of the WG were that the final rule as reflected in the legislation was followed, and NIOSH's review of the petition was claimant friendly. The WG provided a number of recommendations with regard to making the process of submitting a Special Exposure Cohort more user friendly.

2009 Advisory Board Meetings (includes agendas, minutes, and transcripts)



The Advisory Board must adhere to the Federal Advisory Committee Act (FACA). FACA ensures that advice rendered by the Advisory Board be both objective and accessible to the public. In addition, FACA requires that notices for committee meetings are published with adequate advance notice in the Federal Register. The Advisory Board has established both subcommittees and work groups. While FACA does not require a notice to be published in the Federal Register for work group meetings, we will make every attempt to provide advanced notice of work group meetings held by the Advisory Board.

NOTE: Transcripts posted to the Web site after December 12, 2007, will be posted in accordance with the following policy:

Policy on Redaction of Board Meeting Transcripts
(Public Comment)

  1. If a person making a comment gives his or her name, no attempt will be made to redact that name.

  2. NIOSH will take reasonable steps to ensure that individuals making public comment are aware of the fact that their comments (including their name, if provided) will appear in a transcript of the meeting posted on a public Web site. Such reasonable steps include:
    1. A statement read at the start of each public comment period stating that transcripts will be posted and names of speakers will not be redacted;

    2. A printed copy of the statement mentioned in (a) above will be displayed on the table where individuals sign up to make public comment;

    3. A statement such as outlined in (a) above will also appears with the agenda for a Board Meeting when it is posted on the NIOSH Web site;

    4. A statement such as in (a) above will appear in the Federal Register Notice that announces Board and Subcommittee meetings.

  3. If an individual in making a statement reveals personal information (e.g., medical information) about themselves that information will not usually be redacted. The NIOSH FOIA coordinator will, however, review such revelations in accordance with the Freedom of Information Act and the Federal Advisory Committee Act and if deemed appropriate, will redact such information.

  4. All disclosures of information concerning third parties will be redacted.

  5. If it comes to the attention of the Designated Federal Official (DFO) that an individual wishes to share information with the Board but objects to doing so in a public forum, the DFO will work with that individual, in accordance with the Federal Advisory Committee Act, to find a way that the Board can hear such comments.
