TITLE: Federal Motor Carrier Safety Regulations; Waivers, Exemptions, and Pilot Programs ; Final rule; RIN 2126-AA41; Docket No. FMCSA-98-4145; (69 FR 51589).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) adopts as final its interim regulations at 49 CFR part 381, consistent with section 4007 of the Transportation Equity Act for the 21st Century. The final rule establishes procedures applicants must follow to request waivers and apply for exemptions from the Federal Motor Carrier Safety Regulations and Commercial Driver's License requirements, and procedures to propose and manage pilot programs. In addition, it establishes procedures which govern how FMCSA will review, grant, or deny requests for waivers, applications for exemptions, and proposals for pilot programs. It also establishes requirements for publishing notice of exemption applications or proposals for pilot programs through the Federal Register and affording the public an opportunity for comment. As no revisions are necessary, the interim regulations at part 381 are adopted without change.


TITLE: Limitations on the Issuance of Commercial Driver's Licenses With a Hazardous Materials Endorsement ; Interim final rule; delay of compliance date; RIN 2126-AA70; Docket No. FMCSA-2001-11117; (69 FR 51391).

SUMMARY: FMCSA issues this rule to amend the compliance date in its Interim final rule (IFR) published in the May 5, 2003 Federal Register regarding limitations on State issuance of a commercial driver's license (CDL) with a hazardous materials endorsement. States must not issue, renew, transfer or upgrade a CDL with a hazardous materials endorsement unless the Transportation Security Administration (TSA) has first conducted a background records check of the applicant and determined the applicant does not pose a security risk warranting denial of the hazardous materials endorsement. FMCSA is changing the date by which States must comply with TSA regulations to coincide with the new compliance date established by TSA. The compliance date is changed from April 1, 2004, to January 31, 2005.


TITLE: Transportation of Household Goods; Consumer Protection Regulations; Corrections ; Correcting amendments; RIN 2126-AA32; Docket No. FMCSA-97-2979; (69 FR 47386).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) published in the Federal Register of June 11, 2003, an interim final rule revising the requirements governing the interstate transportation of household goods (68 FR 35064). On March 5, 2004, at 69 FR 10570, we issued technical amendments to the interim final rule and its appendix, the consumer pamphlet Your Rights and Responsibilities When You Move. On April 2, 2004, we issued further technical amendments to the rule and appendix, and established a new compliance date of May 5, 2004, for the rule (69 FR 17313). In subpart E of the amended rule appendix, two paragraphs were not properly updated to reflect the technical changes relating to orders for service and bills of lading. In addition, four sections of the rule appendix published on June 11, 2003, and March 5, 2004, contained an erroneous statutory citation for the provision under which a person may seek judicial redress for alleged loss of or damage to household goods by a carrier. Finally, the introductory sentence to a list of requirements in subpart D of the appendix misstated the number of elements in the list. This document corrects the interim final rule by revising these sections of the appendix.


TITLE: Federal Motor Carrier Safety Regulations: Hazardous Materials Safety Permits ; Final rule; RIN 2126-AA07; Docket FMCSA-97-2180; (69 FR 39350).

SUMMARY: The Federal Motor Carrier Safety Administration is establishing a national safety permit program for motor carriers that transport certain hazardous materials in interstate or intrastate commerce. This final rule implements provisions of Federal hazardous materials transportation law. The rule will promote safe and secure transportation of the designated hazardous materials and thereby improve motor carrier safety.


TITLE: Parts and Accessories Necessary for Safe Operation; Fuel Systems ; Final rule; RIN 2126-AA80; Docket FMCSA-02-13589; (69 FR 31302).

SUMMARY: The FMCSA revises the requirements concerning fuel tank fill rates for gasoline- and methanol-fueled light-duty vehicles contained in Subpart E of the Federal Motor Carrier Safety Regulations (FMCSRs). The purpose of the rule is to: Remove a conflict between the fuel tank fill rate requirements of the FMCSRs and those of the Environmental Protection Agency for gasoline and methanol-fueled vehicles up to 14,000 pounds (lbs) Gross Vehicle Weight Rating (GVWR); and to make permanent the terms of the exemptions previously granted to motor carriers operating certain gasoline-fueled commercial motor vehicles (CMVs) manufactured by Ford Motor Company (Ford) and by General Motors (GM). The FMCSA also incorporates into the FMCSRs previously issued regulatory guidance concerning the applicability of the agency's fuel tank rules to vehicles subject to the National Highway Traffic Safety Administration (NHTSA) fuel system integrity standard at the time of manufacture.


TITLE: Minimum Training Requirements for Longer Combination Vehicle (LCV) Operators and LCV Driver-Instructor Requirements; Correction ; Final rule; correction; RIN 2126-AA08; Docket FMCSA-97-2176; (69 FR 28846).

SUMMARY: The Federal Motor Carrier Safety Administration published in the Federal Register of March 30, 2004, a final rule concerning requirements for operators of LCVs and the instructors who train them. The requirements codified at Sec. 391.53 should have been designated Sec. 391.55. In addition, the authority citation for the rule failed to include the authorities listed in another FMCSA rule amending part 391 that was published the same day. This document corrects these errors. Also, under the SUPPLEMENTARY INFORMATION section, we discuss an error in the preamble of the March 30 rule which does not require a correction to the regulatory text.


TITLE: Minimum Training Requirements for Entry-Level Commercial Motor Vehicle Operators ; Final rule; RIN 2126-AA09; FMCSA-1997-2199; (69 FR 29384).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) establishes standards for mandatory training requirements on four specific topics for entry-level operators of commercial motor vehicles (CMVs), who are required to hold or obtain a commercial driver's license (CDL). This action responds to a study mandated by the Intermodal Surface Transportation Efficiency Act of 1991 that found the private sector training of entry-level drivers in the heavy truck, motorcoach, and school bus industries was inadequate. The purpose of this rule is to enhance the safety of CMV operations on our nation's highways.


TITLE: Transportation of Household Goods; Consumer Protection Regulations ; Interim final rule; technical amendments; delay of compliance date; RIN 2126-AA32; FMCSA-97-2979; (69 FR 17313).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) makes further technical amendments to the interim final rule published on June 11, 2003, governing the interstate transportation of household goods (68 FR 35064). On March 5, 2004, we issued technical amendments to the interim final rule and its appendix, the consumer pamphlet Your Rights and Responsibilities When You Move (69 FR 10570). On March 16, 2004, the U.S. Department of Transportation (DOT) received from the American Moving and Storage Association a petition for reconsideration and stay of compliance date of the interim final rule and technical amendments. In response to the petitioner's concerns, we are adopting clarifying technical amendments to the interim final rule and establishing a new compliance date for the rule. However, we believe that certain amendments sought in the petition are not necessary, while others are substantive in nature and will be considered along with other potential substantive amendments in a future rulemaking proceeding. Therefore, the petition is granted in part and denied in part. Today's action is intended to ensure that the household goods regulations and consumer information are consistently accurate, clear, and unambiguous.


TITLE: Safety Performance History of New Drivers ; Final Rule; RIN 2126-AA17; FMCSA-97-2277; (68 FR 16683).

SUMMARY: The Federal Motor Carrier Safety Administration amends the Federal Motor Carrier Safety Regulations (FMCSRs) to specify: The minimum driver safety performance history data that new or prospective employers are required to seek for applicants under consideration for employment as a commercial motor vehicle (CMV) driver; where, and from whom, that information must be sought; and that previous employers must provide the minimum driver safety performance history information. This action will enable prospective motor carrier employers to make more sound hiring decisions of drivers to improve CMV safety on our nation's highways.


TITLE: Minimum Training Requirements for Longer Combination Vehicle (LCV) Operators and LCV Driver-Instructor Requirements ; Final Rule; RIN 2126-AA08; FMCSA-97-2176; (68 FR 16722).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) establishes standards for minimum training requirements for the operators of longer combination vehicles (LCVs) and requirements for the instructors who train these operators. This action is in response to section 4007 of the Intermodal Surface Transportation Efficiency Act of 1991, which directed that training for the operators of LCVs include certification of an operator's proficiency by an instructor who has met the requirements established by the Secretary of Transportation (Secretary). The purpose of this final rule is to enhance the safety of commercial motor vehicle (CMV) operations on our Nation's highways.


TITLE: Transportation of Household Goods; Consumer Protection Regulations ; Interim Final Rule; RIN 2126-AA32; FMCSA-97-2979; (68 FR 10569).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) amends its interim final rule governing the interstate transportation of household goods (68 FR 35064, Jun. 11, 2003). On August 25, 2003, the U.S. Department of Transportation (DOT) received two petitions for reconsideration of the interim final rule. The petitioners requested both substantive and technical amendments. Today's rule incorporates the technical amendments. Substantive amendments requested by the petitioners will require consideration in a future rulemaking proceeding, to give the public an opportunity to comment. This amended interim final rule will benefit both the industry and consumers by more accurately reflecting current industry practices.


PROPOSED RULES

TITLE: Brokers of Household Goods by Motor Vehicle; Advance notice of proposed rulemaking (ANPRM); request for comments on petition for rulemaking; RIN 2126-AA84; FMCSA-2004-17008; (69 FR 76664).

SUMMARY: FMCSA seeks comments on whether additional regulations for property brokers of household goods (HHG) in interstate or foreign commerce are necessary and, if so, what these regulations should include. We have granted a petition from the American Moving and Storage Association to initiate this ANPRM. HHG property brokers sell, offer for sale, negotiate for, or hold themselves out by solicitation, advertisement, or otherwise as selling, providing, or arranging for, transportation of HHG in interstate commerce by motor carriers for compensation. This action is necessary to help determine whether the general property broker regulations have failed to adequately protect consumers during HHG transportation.


TITLE: Hours of Service of Drivers; Supporting Documents; Supplemental notice of proposed rulemaking (SNPRM); request for comments; RIN 2126-AA76; FMCSA-1998-3706; (69 FR 63997).

SUMMARY: The FMCSA intends to clarify that each motor carrier has the duty under the current regulations to: Verify the accuracy of drivershours of service (HOS) and records of duty status (RODS), and this obligation extends to the HOS and RODS of independent drivers or owner-operators while driving for the motor carrier; ensure each driver collects and submits to the employing motor carrier all supporting documents with the RODS; and ensure all motor carriers know of the requirement to maintain supporting documents in a method that allows cross reference to the RODS. This notice also proposes a supporting document based self-monitoring system that would be the carriers primary method for ensuring compliance with the HOS regulations. In recognition of developing technologies, the FMCSA proposes to permit the use of electronic documents as a supplement to, and, in certain circumstances, in lieu of, paper supporting documents. The intended effect of this proposal is to provide clearer and more detailed definitions of supporting documents, employee, driver, and a requirement for each motor carrier to use a self-monitoring system to verify accuracy of HOS and RODS.


TITLE: Rules of Practice ; Supplemental notice of proposed rulemaking (SNPRM); RIN 2126-AA15; FMCSA-1997-2299; (69 FR 61617).

SUMMARY: FMCSA proposes to amend its rules of practice for motor carrier safety, hazardous materials, and other enforcement proceedings. These rules would increase the efficiency of the procedures, enhance due process and the awareness of the public and regulated community, and accommodate recent programmatic changes. The rules would apply to all motor carriers, other business entities, and individuals involved in motor carrier safety and hazardous materials administrative actions and proceedings with FMCSA.


TITLE: Electronic On-Board Recorders for Hours-of-Service Compliance; Advance notice of proposed rulemaking; request for comments; RIN-2126-AA89; FMCSA-2004-18940; (69 FR 53386).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) requests comments on potential amendments to its regulations concerning the use of on-board recording devices to document compliance with the Federal hours-of-service rules. Because our current regulations do not reflect the considerable advances in the technology used in current-generation recording devices (also known as electronic on-board recorders, or EOBRs), we seek information concerning issues that should be considered in the development of improved performance specifications for these recording devices. Our purpose is to ensure that any future requirements would be appropriate as well as reflect state-of-the-art communication and information management technologies.


TITLE: Interstate School Bus Safety; Withdrawal; Withdrawal of advance notice of proposed rulemaking (ANPRM); RIN 2126-AA53; FMCSA-2000-7174; (69 FR 13803).

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) withdraws its October 22, 2001, advance notice of proposed rulemaking (ANPRM) concerning whether to extend the applicability of the Federal Motor Carrier Safety Regulations (FMCSRs) to all interstate school transportation operations (excluding home-to-school or school-to-home transportation) by local governmentally operated educational agencies. After reviewing the public comments on the ANPRM, the agency determined that no regulatory action is needed. Therefore, interstate school transportation operations by local governmentally operated educational agencies will continue to be exempt from all FMCSRs except the commercial driver's license regulations and the controlled substances and alcohol testing regulations.

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) clarifies its September 8, 2000 policy statement implementing section 222 of the Motor Carrier Safety Improvement Act of 1999. Section 222 requires the agency to assess maximum statutory penalties if a person is found to have committed a pattern of violations of critical or acute regulations, or previously committed the same or a related violation of critical or acute regulations. This notice clarifies the agency use of previous violations to assess maximum penalties under section 222. It also discusses the notification procedures and extraordinary circumstances that may warrant assessment of less than the maximum penalty.

SUMMARY: This notice publishes the FMCSA decision to renew the exemptions from the vision requirement in the Federal Motor Carrier Safety Regulations for 22 individuals. SUMMARY: This notice invites you to participate in a forum titled, FMCSA R&T: Today and Tomorrow, sponsored by FMCSA's Office of Research and Technology (R&T) in conjunction with the 84th Annual Meeting of the Transportation Research Board (TRB). The purpose of the forum is to provide insight on some of the research and technology work that FMCSA sponsors in support of its missions of reducing the number and severity of commercial motor vehicle (CMV) crashes and fatalities and enhancing efficiency of CMV operations. Presenters will speak about current FMCSA R&T projects and the status of studies and technologies under consideration as part of the draft R&T 5-Year Strategic Plan. Speaker topics will cover the Crash Causation Study, Electronic On-Board Recorders, the HazMat Operational Test, Vehicle Infrastructure Integration, and Fatigue Management Technologies. The keynote address will feature a trucking association representative who will discuss both safety partnerships between industry and FMCSA and the role that research and technology plays in helping the trucking industry move towards safer, more efficient and secure operations. There will be an opportunity for attendees to talk with FMCSA subject-matter experts in an open question and answer session.

SUMMARY: In notice document 04-21139 beginning on page 56474 in the issue of Tuesday, September 21, 2004, make the following correction: On page 56474, in the first column, in the DATES section, in the second line, (September 21, 2004) should read (September 21, 2006).


TITLE: Exemption To Allow Werner Enterprises, Inc. To Use Global Positioning System (GPS) Technology To Monitor and Record Drivers' Hours of Service ; Grant of exemption; FMCSA-2003-15818; 69 FR 56474.

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) grants to Werner Enterprises, Inc. (Werner) an exemption from the requirement that drivers of commercial motor vehicles (CMVs) operating in interstate commerce prepare handwritten records of duty status (RODS). The exemption allows Werner to document its drivers' hours of service through the use of GPS technology and complementary computer software programs. The terms and conditions for the exemption are the same as those proposed in the agency's December 11, 2003, notice and request for comments, with the exception of the elimination of requirements for quarterly status reports and driver-specific violation reports. FMCSA has monitored closely Werner's use of the GPS technology and complementary computer software programs since June 1998. Based on this experience, the agency believes the terms and conditions of the exemption achieve a level of safety equivalent to, or greater than, that provided by complying with the current RODS requirements

TITLE: Comprehensive Safety Analysis 2010 Initiative ; Notice of Public Listening Sessions; FMCSA-2004-18898; 69 FR 51748.

SUMMARY: The Federal Motor Carrier Safety Administration (FMCSA) announces a series of Public Listening Sessions to solicit input on ways the FMCSA can improve its process of monitoring and assessing the afety of the motor carrier industry and how that information should be presented to the public. FMCSA is calling this effort the Comprehensive Safety Analysis 2010 Initiative. Through its current compliance review process, FMCSA is able to conduct compliance reviews on only a small percentage of the 675,000 active interstate motor carriers. The FMCSA is looking for ways to improve monitoring of motor carriers, to make agency processes more efficient, and to expand its enforcement and compliance reach in the regulated community in order to improve FMCSA's ability to meet its goal of significantly reducing crashes, fatalities, and injuries involving large trucks and buses.

SUMMARY: This notice publishes the FMCSA decision to renew the exemptions from the vision requirement in the Federal Motor Carrier Safety Regulations for 26 individuals. The FMCSA has statutory authority to exempt individuals from vision standards if the exemptions granted will not compromise safety. The agency has concluded that granting these exemptions will provide a level of safety that will be equivalent to, or greater than, the level of safety maintained without the exemptions for these commercial motor vehicle (CMV) drivers.

SUMMARY: The FMCSA announces its denial of 81 applications from individuals who requested an exemption from the Federal vision standard applicable to interstate truck drivers and the reasons for the denials. The FMCSA has statutory authority to exempt individuals from the vision standard if the exemptions granted will not compromise safety. The agency has concluded that granting these exemptions does not provide a level of safety that will equal or exceed the level of safety maintained without the exemptions for these commercial motor vehicle drivers.

SUMMARY: FMCSA announces the availability of its Guidance for the use of binding arbitration in civil penalty forfeiture proceedings in which the only issues remaining to be resolved are the amount of the civil penalty owed and the length of time in which to pay it. Effective Date March 4, 2004.

SUMMARY: The FMCSA is publishing its final Order on agency procedures for implementing the National Environmental Policy Act of 1969 (NEPA). Now that the FMCSA is a separate agency within the Department of Transportation (Department or DOT), it has developed its own environmental procedures for complying with NEPA, other pertinent environmental regulations, Executive Orders, statutes, and laws to ensure that it actively incorporates environmental considerations into informed decisionmaking.

SUMMARY: The FMCSA denies Mayflower Transit LLC and United Van Lines' LLC application for exemptions from certain Federal controlled substance and alcohol testing requirements. The applicants requested exemptions that would allow them to impose controlled substance and alcohol testing on their non-CDL (commercial drivers license) drivers using the same standards, forms and requirements, and in the same random testing pool, as their CDL drivers. The FMCSA denies the exemptions because Mayflower Transit LLC and United Van Lines LLC did not explain how they would achieve a level of safety that is equivalent to, or greater than, the level of safety that would be obtained by complying with the random controlled substances and alcohol testing requirements.
