About the U.S. Trustee Program

The United States Trustee Program is the component of the Department of Justice responsible for overseeing the administration of bankruptcy cases and private trustees under 28 U.S.C.
§ 586 and 11 U.S.C. § 101, et seq. We are a national program with broad administrative, regulatory, and litigation/enforcement authorities whose mission is to promote the integrity and efficiency of the bankruptcy system for the benefit of all stakeholders–debtors, creditors, and the public. The USTP consists of an Executive Office in Washington, DC, and 21 regions with 92 field office locations nationwide.

Updated Census Bureau Median Family Income Data
October 16, 2020

The Census Bureau’s Median Family Income Data accessible through the “Means Testing Information” page has been updated. The U.S. Trustee Program will apply the updated data to all cases filed on or after November 1, 2020.

 
 
U.S. Trustee Program Extends Telephonic or Video Section 341 Meeting
August 28, 2020

The U.S. Trustee Program has extended the requirement that section 341 meetings be conducted by telephone or video appearance to all cases filed during the period of the President’s “Proclamation on Declaring a National Emergency Concerning the Novel Coronavirus Disease (COVID-19) Outbreak” issued March 13, 2020, and ending on the date that is 60 days after such declaration terminates. However, the U.S. Trustee may approve a request by a trustee in a particular case to continue the section 341 meeting to an in-person meeting in a manner that complies with local public health guidance, if the U.S. Trustee determines that an in-person examination of the debtor is required to ensure the completeness of the meeting or the protection of estate property. This policy may be revised at the discretion of the Director of the United States Trustee Program.

The U.S. Trustee Program is extending the requirement that section 341 meetings be conducted by telephone or video appearance to all cases filed through October 10, 2020. However, if the responsible U.S. Trustee or case trustee determines that an in-person examination of the debtor is required to ensure the completeness of the meeting or protection of estate property, the U.S. Trustee may approve the continuation of the section 341 meeting to an in-person meeting in a manner that complies with local public health guidance.

 
 
U.S. Trustee Program Extends Telephonic Section 341 Meetings to Cases Filed Through July 10, 2020
April 24, 2020

The U.S. Trustee Program is extending the requirement that section 341 meetings be conducted only through telephonic or other alternative means not requiring in-person appearance to all cases filed through July 10, 2020. Appropriate notice will be provided to parties in accordance with bankruptcy law and rules.

 
 
USTP Issues Public Report of Debtor Audits for FY 2019
April 20, 2020

As required by section 603(a)(2)(D) of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, Public Law 109-8, the U.S. Trustee Program has issued its
annual public report on debtor audits. The report provides the aggregate results of audits of individual chapter 7 and chapter 13 cases for Fiscal Year 2019.

 
 
Updated Administrative Expense Multipliers & IRS Data
April 15, 2020

The Administrative Expense Multipliers and IRS’s National Standards for Allowable Living Expenses and Local Standards for Transportation and Housing and Utilities Expenses accessible through the “Means Testing Information” page has been updated. The revised multipliers and standards will apply to cases filed on or after May 1, 2020

Change in Chapter 11 Quarterly Fee Payment Processing Time
April 1, 2020

Due to the COVID-19 pandemic, Chapter 11 quarterly fee payments made through the U.S. Bank lockbox may take up to 72 hours to process. This extended processing time is effective through June 1, 2020. Debtors will not be adversely affected or penalized by this delayed processing time. Chapter 11 quarterly fees may also be paid online at https://www.pay.gov/public/form/start/672415208.
