11/30/20 PIH PIH Notice COVID-19 Statutory and Regulatory Waivers and Alternative Requirements for the Public Housing, Housing Choice Voucher (including Mainstream and Mod Rehab), Indian Housing Block Grant and Indian Community Development Block Grant programs, Suspension of Public Housing Assessment System and Section Eight Management Assessment Program, Revision 2 (PIH Notice 2020-33):  The Coronavirus Aid, Relief and Economic Security (CARES) Act (Public Law 116-136) provides the U.S. Department of Housing and Urban Development (HUD) with broad authority to waive or establish alternative requirements for numerous statutory and regulatory requirements for the Public Housing program, Housing Choice Voucher (HCV) program, Indian Housing Block Grant (IHBG) program, and Indian Community Development Block Grant (ICDBG) program. 11/25/20 PIH Federal Register Housing Choice Voucher Mobility Demonstration, Extension of Application Due Date: On July 15, 2020, HUD published a notice (“Notice”) implementing the Housing Choice Voucher (HCV) mobility demonstration (“demonstration”) authorized by the Consolidated Appropriations Act, 2019. Through this Notice, HUD is making available up to $50,000,000 to participating Public Housing Authorities (PHAs) throughout the country to implement housing mobility programs by offering mobility-related services to increase the number of voucher families with children living in opportunity areas.
111/23/20 HUD Federal Register Acceptance of Private Flood Insurance for FHA-Insured MortgagesThis proposed rule would amend Federal Housing Administration (FHA) regulations to allow mortgagors the option to purchase private flood insurance on FHA-insured mortgages for properties located in Special Flood Hazard Areas (SFHAs), in satisfaction of the mandatory purchase requirement of the Flood Disaster Protection Act of 1973 (the FDPA).
11/20/20 PIH PIH Notice Guidance for PHAs on the Allowability of Remote Hearings and Remote Briefings (PIH Notice 2020-32): The Coronavirus Disease 2019 (COVID-19) and social distancing requirements present significant challenges for public housing agencies (PHAs) to conduct in-person hearings and briefings. As remote environments become more common, this guidance presents best practices for determining if barriers exist to conducting a remote hearing or remote briefing.
11/19/20 OGC Federal Register Notice of Regulatory Waiver Requests Granted for the Second Quarter of Calendar Year 2020 The purpose of this notice is to comply with the requirements of the HUD Reform Act. This notice contains a list of regulatory waivers granted by HUD during the period beginning on April 1, 2020 and ending on June 30, 2020.

11/12/20 PIH PIH Notice Remote Video Inspections for Housing Choice Voucher Program (PIH Notice 2020-31) - This notice gives public housing agencies (PHAs) guidance on conducting Housing Quality Standards (HQS) inspections using Remote Video Inspections (RVIs). In RVIs, an HQS inspector performs an HQS inspection from a remote location using video streaming technology via a person at the inspection site who serves as a proxy.
11/12/20 PIH Federal Register Relief from HUD Public Housing and Section 8 Requirements Available During CY 2020 and CY 2021 to Public Housing Agencies to Assist with Recovery and Relief Efforts on Behalf of Families Affected by Presidentially Declared Major Disasters - This notification advises the public that HUD, in order to more effectively and expeditiously respond to Presidentially declared Major Disaster Declarations (MDDs), is establishing for calendar year (CY) 2020 and CY 2021 an expedited process for the review of requests for relief from HUD regulatory and/or administrative requirements (“HUD requirements”) for Public Housing Agencies (PHAs) located in counties that are included in MDDs.
11/12/20 PIH Federal Register Housing Opportunity Through Modernization Act of 2016-Housing Choice Voucher (HCV) and Project-Based Voucher Implementation; Additional Streamlining Changes; Extension of Comment Period - On October 8, 2020, HUD published in the Federal Register a notice of proposed rulemaking entitled “Housing Opportunity through Modernization Act of 2016: Housing Choice Voucher and Project-Based Voucher Implementation; Additional Streamlining Changes”, proposing comprehensive amendments to the regulations governing the Housing Choice Voucher (HCV) and Project-Based Voucher (PBV) programs, largely in response to the enactment of the Housing Opportunity Through Modernization Act (HOTMA).
11/3/20 PIH Federal Register Removal and Archiving of Additional Obsolete and Superseded Guidance Documents - This notice announces that the Department has completed a second review of administrative guidance and identified guidance documents that should no longer be in effect or are deemed unnecessary and obsolete as part of the Department's implementation of Executive Order 13891, “Promoting the Rule of Law Through Improved Agency Guidance Documents.”

HOTMA made numerous changes that affect either the Housing Choice Voucher (HCV) tenant-based program or the Project-Based Voucher (PBV) program, or both.
10/6/20 PIH PIH Notice Foster Youth to Independence (PIH Notice 2020-28) - Through the Foster Youth to Independence (FYI) initiative HUD will provide Housing Choice Vouchers (HCVs) for youth eligible under the Family Unification Program (FUP), subject to availability. 8/28/20 PIH Federal Register Operations Notice for the Expansion of the Moving to Work Demonstration Program - This final Operations Notice for the Expansion of the MTW Demonstration Program establishes requirements for the implementation and continued operation of the MTW demonstration program pursuant to the 2016 MTW Expansion Statute, which authorizes HUD to expand the MTW demonstration program from the current size of 39 agencies to an additional 100 agencies over a period of 7 years.
8/26/20 PIH PIH Notice Section 8 Moderate Rehabilitation Program – CARES Act Supplemental HAP Funding Allocation and COVID-19 Waivers and Alternative Requirements (PIH Notice 2020-20) - This notice describes HUD’s allocation methodology to PHAs for the supplemental Mod Rehab HAP funds provided from these PBRA funds. In addition, pursuant to the waiver authority provided under the CARES Act, through this notice HUD is waiving and establishing alternative requirements for numerous statutory and regulatory requirements for the Section 8 Mod Rehab program to expedite or facilitate the use of these amounts to prevent, prepare for, and respond to coronavirus.
8/21/20 PIH PIH Notice Rent Reasonableness – Defining Assisted Units for the Housing Choice Voucher and Project-Based Voucher Programs (PIH Notice 2020-19) - This notice supersedes Notice PIH 2011–46, and updates guidance concerning what is considered an assisted unit under HCV and PBV for the purpose of rent reasonableness requirements.
8/12/20 PIH Federal Register Notice of Regulatory Waiver Requests Granted for the First Quarter of Calendar Year 2020 - The purpose of this notice is to comply with the requirements of section 106 of the HUD Reform Act. This notice contains a list of regulatory waivers granted by HUD during the period beginning on January 1, 2020 and ending on March 31, 2020.

7/28/20 PIH PIH Notice Implementation of Public Housing Operating Fund Shortfall Funding from Federal Fiscal Year (FFY) 2020 Appropriations (PIH Notice 2020-16) - This notice implements a provision in the FFY 2020 Further Consolidated Appropriations Act (Public Law 116-94), referred to hereafter as “the Act,” which provides for a $25 million set-aside of Public Housing Operating Funds to assist PHAs experiencing financial insolvency. Specifically, this notice provides guidance regarding eligibility, the process for applying, and other requirements for the set-aside.
7/17/20 PIH PIH Notice Revised Loan Limits for the Section 184 Indian Home Loan Guarantee Program (Notice PIH 2020-15) - The purpose of this Notice is to update the mortgage loan limits for the Section 184 Indian Home Loan Guarantee program.
7/8/20 PIH PIH Notice Registration of Interest for HUD-VASH Vouchers (Notice PIH 2020-14) - This notice announces the availability of $50 million in HUD-VASH funding that will support approximately 6,000 new HUD-VASH vouchers.
7/2/20 PIH PIH Notice COVID-19 Statutory and Regulatory Waivers and Alternative Requirements for the Public Housing, Housing Choice Voucher, Indian Housing Block Grant and Indian Community Development Block Grant programs, Suspension of Public Housing Assessment System and Section Eight Management Assessment Program, Revision 1 (Notice PIH 2020-13) - In Notice PIH 2020–05, HUD exercised its authority under the CARES Act to establish waivers and administrative flexibilities to provide relief to PHAs, Indian tribes, and TDHEs in response to the COVID-19 pandemic. In this revision to that Notice, HUD restates the waivers and alternative requirements established previously, provides additional waivers and alternative requirements, extends the periods of availability for previously established waivers and alternative requirements, and issues technical amendments to several of the previously established waivers and alternative requirements.

3/9/20 PIH Federal Register Section 8 Housing Assistance Payments Program - Fiscal Year 2020 Inflation Factors for Public Housing Agency Renewal Funding - The notice apportions the expected percent change in national Per Unit Cost for the HCV program, 4.25 percent, to each PHA based on the change in Fair Market Rents for their operating area to produce the FY 2020 RFIFs. 
2/28/20 PIH PIH Notice Public Housing Operating Fund (OpFund) Grant Eligibility Calculations and Processing for Calendar Year (CY) 2020 (PIH-2020-03) - This notice provides public housing agencies with instructions for calculating OpFund grants for CY 2020 and establishes submission deadlines.
2/28/20 PIH Federal Register Administrative Guidelines: Subsidy Layering Review for Project-Based Vouchers - This notice provides updated Administrative Guidelines and requirements for Project-Based Voucher (PBV) Subsidy Layering Reviews (SLR), to include new PBV Housing Assistance Payments contract terms provisions, as amended by the Housing Opportunity Through Modernization Act of 2016, and SLR requirements for Mixed-Finance projects that may or may not include PBV assistance.
2/27/20 PIH PIH Notice Section 209 of the Economic Growth, Regulatory Relief, and Consumer Protection Act: Guidance for Shared Waiting Lists (PIH-2020-02) - Through this notice, HUD complies with Section 209(e) of the Economic Growth, Regulatory Relief and Consumer Protection Act of 2018, Pub. No. 115-174, by providing guidance regarding how to facilitate the voluntary use of shared waiting lists among public housing agencies and owners of multifamily properties that receive assistance from HUD.
2/27/20 PIH Federal Register Economic Growth, Regulatory Relief, and Consumer Protection Act: Initial Guidance on Property Inspections and Environmental Reviews - This notice explains how HUD designates small PHAs and implements section 209 provisions that reduce regulatory burden on small PHAs by reducing the number of inspections required for units with section 8(o) voucher assistance, and providing an exemption from environmental review requirements for development and modernization projects that have a total cost of not more than $100,000.

8/14/19 PIH Federal Register 60-Day Notice of Proposed Information Collection: Alternative Inspections—Housing Choice Voucher Program - Under the Section 8 housing choice voucher rule, PHAs that elect to rely on an alternative inspection are required to meet the requirements of subpart I of the rule. If the inspection method and standard selected is other than HOME Investment Partnerships (HOME) program, Low-Income Housing Tax Credits (LIHTCs), or that performed by HUD, the PHA must submit a request to HUD. They are a streamlined appeal; an appeal for specific local conditions; an appeal for changing market conditions; and an appeal to substitute actual project cost data. 7/26/18 PIH Federal Register Housing Opportunity Through Modernization Act of 2016: Final Implementation of Public Housing Income Limit: HOTMA was signed into law on July 29, 2016. Section 103 of HOTMA amends section 16(a) of the United States Housing Act of 1937 to place an income limitation on a public housing tenancy for families. The law requires that after a family’s income has exceeded 120 percent of the area median income (AMI) (or a different limitation established by the Secretary) for two consecutive years, a public housing agency (PHA) must terminate the family’s tenancy within 6 months of the second income determination or charge the family a monthly rent equal to the greater of (1) the applicable Fair Market Rent (FMR); or (2) the amount of monthly subsidy for the unit including amounts from the operating and capital fund, as determined by regulations. 4/24/18 PIH Federal Register Notice of Final Determination for the MOWA Band of Choctaw Indian Tribe’s Request for Expansion of Their Formula Area: This notice advises the public that the MOWA Band of Choctaw Indian Tribe has requested an expansion of their Formula Area that will overlap with the Poarch Creek Tribe’s Formula Area. HUD made a preliminary determination that the MOWA Band of Choctaw Indian Tribe met the requirements for expanding its Formula Area to include the balance of Mobile County, Alabama. Poarch Creek, an affected tribe was notified and had opportunity to comment. HUD received no comments from the affected tribe. The Housing and Community Development Act of 1974, as amended, at sections 102(a)(6) and 102(e) requires that any county seeking qualification as an urban county notify each unit of general local government within the county that such unit may enter into a cooperation agreement to participate in the CDBG program as part of the county. 60-Day Notice of Proposed Information Collection: Public Housing Agency Executive Compensation Information: Pursuant to a notice issued annually (most recently PIH Notice 2017–11), HUD collects information on the compensation provided by public housing agencies (PHAs) to its employees. More specifically, under this collection PHAs are to report the compensation paid to the top management official, the top financial official, and all employees who are paid an annual salary over the compensation cap imposed by Congress in HUD’s annual appropriations (Level IV of the Executive Schedule). 1/26/18 PDR Federal Register Federal Policy for the Protection of Human Subjects: Delay of the Revisions to the Federal Policy for the Protection of Human Subjects; On January 19, 2017, HUD and other federal departments and agencies published a final rule which revised the Federal Policy for the Protection of Human Subjects (2018 Requirements). Most of the 2018 Requirements were scheduled to become effective on January 19, 2018, with a general compliance date of January 19, 2018. On January 22, 2018, the Federal departments and agencies that adopted the 2018 Requirements published an interim final rule (‘‘the interagency interim final rule’’) that delays the effective date and general compliance date of the 2018 Requirements for six months, to July 19, 2018. Since October 2011, all Public Housing Agencies (PHAs) operating the Housing Choice Voucher (HCV) program in the Dallas, TX HUD Metro FMR Area have been using Small Area Fair Market Rents (Small Area FMRs). The use of Small Area FMRs was intended to give HCV families access to areas of high opportunity and lower poverty by providing a subsidy that is adequate to cover rents in those areas, thereby reducing the number of voucher families that reside in areas of high poverty concentration. Section 184 Indian Housing Loan Guarantee Program Increase to Annual Premium: The Section 184 Indian Housing Loan Guarantee program (Section 184 program) is a home
mortgage program specifically designed for American Indian and Alaska Native families, Alaska villages, tribes, or tribally designated housing entities. Over the last five years, the Section 184 program has doubled the number of loans and eligible families being assisted by the program. For HUD to continue to meet the increasing demand for participation in this program, HUD is exercising its authority to increase the annual premium to the borrower from 0.15 to 0.25 percent of the remaining loan balance. This annual premium will continue until the unpaid principal balance, excluding the upfront loan guarantee fee, reaches 78 percent of the lower of the initial sales price or appraised value based on the initial amortization schedule. Effective December 1, 2016 the new annual premium of 0.25 percent of the remaining loan balance will apply to all new loan guarantees, including refinances. Alternative Requirements for Family Unification Program (FUP). In a HUD study of the FUP program, a major barrier to greater youth participation was the time limit on the rental subsidy.1 PHAs and public child welfare agencies (PCWAs) suggested the 18-month time limit is too short, noting that landlords generally prefer annual leases with full 12-month renewals. The limited time causes high turnover rates demanding greater staff resources and creating greater administrative costs. The 18-month restriction does not align with a standard academic term for youth enrolled in an education program. Finally, youth simply need more time to become self-sufficient and transition to independent living. Implementation of this demonstration requires will be through a notice issued by the Office of Public and Indian Housing.

There are two different PHA Plans: the Five-Year Plan and the Annual Plan. The Five-Year Plan describes the agency’s mission and longrange goals and objectives for achieving its mission over a five-year period, and their approach to managing programs and providing services for the upcoming year. The Annual PHA Plan is a comprehensive guide to PHA policies, programs, operations, and strategies for meeting local housing needs and goals. Instituting a Smoke Free Public Housing: This proposed rule would require each public housing agency (PHA) administering public housing to implement a smoke-free policy. Specifically, this rule proposes that no later than 18 months from the effective date of the final rule, each PHA must implement a policy prohibiting lit tobacco products in all living units, indoor common areas in public housing, and in PHA administrative office buildings (in brief, a smoke-free policy for all public housing indoor areas). The smoke-free policy must also extend to all outdoor areas up to 25 feet from the housing and administrative office buildings. HUD proposes implementation of smoke-free public housing to improve indoor air quality in the housing, benefit the health of public housing residents and PHA staff, reduce the risk of catastrophic fires, and lower overall maintenance costs. 30 Day Notice of Proposed Information Collection: Family Self Sufficiency Program Demonstration:  Previously HUD administered the FSS program as two separate programs—one for Housing Choice Voucher (Section 8) participants and one for Public Housing participants. Consolidated Appropriations Act, 2014 provided, however, that the two programs be merged into one program under a separate line item. The objective of the FSS program is to enable participating low-income families to increase their earned income and reduce their dependency on welfare assistance and rental subsidies. The Secretary shall appoint an advisory committee to provide advice to the Office of Housing Counseling (OHC). The value of the Housing Counseling Federal Advisory Committee (HCFAC) will be to advise the OHC to meet its mission to provide individuals and families with the knowledge they need to obtain, sustain, and improve their housing through a strong national network of HUD approved housing counseling agencies and HUD-certified counselors. To meet the requirements of the Uniform Physical Condition Standards (UPCS), the Physical Condition of Multifamily Properties and the Public Housing Assessment System (PHAS) rules, the Department conducts physical condition inspections of approximately 14,000 multifamily and public housing properties annually. To conduct these inspections, HUD uses contract inspectors that are trained and certified in the Uniform Physical Condition Standards protocol by HUD. Individuals who wish to be trained and certified by HUD are requested to electronically submit the questionnaire via the Internet. The questionnaire provides HUD with basic knowledge of an individual’s inspection skills and abilities. Affirmatively Furthering Fair Housing: Re-Opening Public Comment Period on Subject of Later First AFH Submission Date for Certain Entities: Through this rule, HUD proposes to provide HUD program participants with more effective means to affirmatively further the purposes and policies of the Fair Housing Act, which is Title VIII of the Civil Rights Act of 1968. The Fair Housing Act not only prohibits discrimination but, in conjunction with other statutes, directs HUD’s program participants to take steps proactively to overcome historic patterns of segregation, promote fair housing choice, and foster inclusive communities for all. Comments are due by February 17, 2015.

Streamlining Administrative Regulations for Public Housing, Housing Choice Voucher, Multifamily Housing, and Community Planning and Development Programs Proposed Rule. Section 243 of the Department of Housing and Urban Development Appropriations Act, 2014 (2014 Appropriations Act), authorized HUD to implement certain statutory changes to the United States Housing Act of 1937 (1937 Act) made by the 2014 Appropriations Act through notice, followed by notice and comment rulemaking. Notices implementing the changes were published on May 19, 2014, and June 25, 2014. Consistent with statutory direction, this proposed rule commences the rulemaking process to codify in regulation the statutory changes made to the 1937 Act by the 2014 Appropriations Act and to solicit comment on HUD’s implementation of these changes through the published notices.
