Housing and Community Development Act of 1980: Verification of Eligible Status: This proposed rule would make two changes to HUD’s regulations implementing section 214 of the Housing and Community Development Act of 1980, as amended (Section 214). Section 214 prohibits the Secretary of HUD from making financial assistance available to persons other than United States citizens or certain categories of eligible noncitizens in HUD’s public and specified assisted housing programs. 60-Day Notice of Proposed Information Collection: Public Housing Operating Subsidy—Appeals.  Under the operating fund rule, PHAs that elect to file an appeal of their subsidy amounts are required to meet the appeal requirements set forth in subpart G of the rule. There are four grounds of appeal in 24 CFR 990.245 under which PHAs may appeal the amount of their subsidy. They are a streamlined appeal; an appeal for specific local conditions; an appeal for changing market conditions; and an appeal to substitute actual project cost data. 60-Day Notice of Proposed Information Collection: Public Housing Operating Fund Program: Operating Budget and Related Form.  The operating budget and related form are submitted by PHAs for the low-income housing program. The operating budget provides a summary of proposed budget receipts and expenditures by major category, as well as blocks for indicating approval of budget receipts and expenditures by the PHA and HUD. Section 8 Housing Assistance Payments Program—Annual Adjustment Factors, Fiscal Year 2019.  The United States Housing Act of 1937 requires that certain assistance contracts signed by owners participating in the Department’s Section 8 housing assistance payment programs provide annual adjustments to monthly rentals for units covered by the contracts. This notice announces FY 2019 AAFs for adjustment of contract rents on the anniversary of those assistance contracts. The factors are based on a formula using residential rent and utility cost changes from the most recent annual Bureau of Labor Statistics Consumer Price Index (CPI) survey.  More information can be found here.

30-Day Notice of Proposed Information Collection: Closeout Instruction for Community Development Block Grant (CDBG) Program. The closeout instructions apply to Community Development Block Grant (CDBG) programs (State CDBG Program, CDBG Disaster Recovery Supplemental Funding, CDBG-Recovery Act (CDBG–R)) and Neighborhood Stabilization Programs (NSP) 1, 2, & 3. Section 570.509 of the CDBG regulations contains the grant closeout criteria for Entitlement jurisdictions when HUD determines, in consultation with the recipients that a grant can be closed. 60-Day Notice of Proposed Information Collection: Public Housing Agency Executive Compensation Information: Pursuant to a notice issued annually (most recently PIH Notice 2017–11), HUD collects information on the compensation provided by public housing agencies (PHAs) to its employees. More specifically, under this collection PHAs are to report the compensation paid to the top management official, the top financial official, and all employees who are paid an annual salary over the compensation cap imposed by Congress in HUD’s annual appropriations (Level IV of the Executive Schedule). Notice for Suspension of Small Area Fair Market Rent (Small Area FMR) Designations; Solicitation of Comment. Since October 2011, all Public Housing Agencies (PHAs) operating the Housing Choice Voucher (HCV) program in the Dallas, TX HUD Metro FMR Area have been using Small Area Fair Market Rents (Small Area FMRs). The use of Small Area FMRs was intended to give HCV families access to areas of high opportunity and lower poverty by providing a subsidy that is adequate to cover rents in those areas, thereby reducing the number of voucher families that reside in areas of high poverty concentration. Family Self-Sufficiency Performance Measurement System (‘‘Composite Score’’). In pursuit of advancing HUD’s ability to evaluate the effectiveness of the FSS program, per statutory mandate (Section 23(i)(2) of the Housing Act of 1937), HUD has developed a new FSS performance measurement system to provide HUD, Congress, and public housing agencies (PHAs) with information on the performance of individual FSS programs. The information will help PHAs determine the extent to which PHAs are administering effective and impactful FSS programs that help participants to successfully graduate from the program and make progress toward economic security. FINAL RULE: Housing Counseling: New Certification Requirements; On December 14, 2016, HUD published a final rule implementing changes to HUD’s housing counseling statute to improve the effectiveness of housing counseling in HUD programs by, among other things: Establishing the Office of Housing Counseling and giving this office the authority over the establishment, coordination, and administration of all regulations, requirements, standards, and performance measures under programs and laws administered by HUD that relate to housing counseling; requiring that organizations providing housing counseling required under or in connection with HUD programs to be approved to participate in the Housing Counseling Program (Housing Counseling Agencies, or HCAs) and have all individuals providing such housing counseling certified by HUD as competent to provide such services; prohibiting the distribution of housing counseling grant funds awarded to agencies participating in HUD’s Housing Counseling Program.

Allocations, Common Application, Waivers, and Alternative Requirements for Community Development Block Grant Disaster Recovery Grantees: This notice allocates $1,805,976,000 in Community Development Block Grant disaster recovery (CDBG–DR) funds appropriated by the Further Continuing and Security Assistance Appropriations Act, 2017 for the purpose of assisting long-term recovery in Florida, Louisiana, North Carolina, South Carolina, Texas, and West Virginia. This allocation of CDBG–DR supplements funds appropriated by the Continuing Appropriation Act, 2017. It provided $500 million in CDBG–DR funding that has been allocated to Louisiana, Texas, and West Virginia in response to qualifying disasters. Housing Opportunity Through Modernization Act of 2016: Implementation of Various Section 8 Voucher Provisions. This document implements new statutory provisions regarding certain inspection requirements for both HCV tenant-based and PBV assistance (found in § 101(a)(1) of HOTMA), the definition of PHA-owned housing (§ 105 of HOTMA), and changes to the PBV program at large (§ 106 of HOTMA) by providing the additional information needed for PHAs and owners to use those provisions. Section 184 Indian Housing Loan Guarantee Program Increase to Annual Premium: The Section 184 Indian Housing Loan Guarantee program (Section 184 program) is a home
mortgage program specifically designed for American Indian and Alaska Native families, Alaska villages, tribes, or tribally designated housing entities. Over the last five years, the Section 184 program has doubled the number of loans and eligible families being assisted by the program. For HUD to continue to meet the increasing demand for participation in this program, HUD is exercising its authority to increase the annual premium to the borrower from 0.15 to 0.25 percent of the remaining loan balance. This annual premium will continue until the unpaid principal balance, excluding the upfront loan guarantee fee, reaches 78 percent of the lower of the initial sales price or appraised value based on the initial amortization schedule. Effective December 1, 2016 the new annual premium of 0.25 percent of the remaining loan balance will apply to all new loan guarantees, including refinances. Alternative Requirements for Family Unification Program (FUP). In a HUD study of the FUP program, a major barrier to greater youth participation was the time limit on the rental subsidy.1 PHAs and public child welfare agencies (PCWAs) suggested the 18-month time limit is too short, noting that landlords generally prefer annual leases with full 12-month renewals. The limited time causes high turnover rates demanding greater staff resources and creating greater administrative costs. The 18-month restriction does not align with a standard academic term for youth enrolled in an education program. Finally, youth simply need more time to become self-sufficient and transition to independent living. Implementation of this demonstration requires will be through a notice issued by the Office of Public and Indian Housing.

Instituting a Smoke Free Public Housing: This proposed rule would require each public housing agency (PHA) administering public housing to implement a smoke-free policy. Specifically, this rule proposes that no later than 18 months from the effective date of the final rule, each PHA must implement a policy prohibiting lit tobacco products in all living units, indoor common areas in public housing, and in PHA administrative office buildings (in brief, a smoke-free policy for all public housing indoor areas). The smoke-free policy must also extend to all outdoor areas up to 25 feet from the housing and administrative office buildings. HUD proposes implementation of smoke-free public housing to improve indoor air quality in the housing, benefit the health of public housing residents and PHA staff, reduce the risk of catastrophic fires, and lower overall maintenance costs. 30 Day Notice of Proposed Information Collection: Family Self Sufficiency Program Demonstration:  Previously HUD administered the FSS program as two separate programs—one for Housing Choice Voucher (Section 8) participants and one for Public Housing participants. Consolidated Appropriations Act, 2014 provided, however, that the two programs be merged into one program under a separate line item. The objective of the FSS program is to enable participating low-income families to increase their earned income and reduce their dependency on welfare assistance and rental subsidies. 30 Day Notice of Proposed Information Collection: Family Unification Program.The Family Unification Program (FUP) is a program, authorized under section 8(x) of the United States Housing Act of 1937 (42 U.S.C. 1437(X), that provides housing choice vouchers to PHAs to assist families for whom the lack of adequate housing is a primary factor in the imminent placement of the family’s child or children in out-of-home care; or the delay in the discharge of the child, or children, to the family from out-of home care. Youths at least 18 years old and not more than 21 years old (have not reached 22nd birthday) who left foster care at age 16 or older and who do not have adequate housing are also eligible to receive housing assistance under the FUP. As required by statute, a FUP voucher issued to such a youth may only be used to provide housing assistance for the youth for a maximum of 18 months. HUD TO IMPLEMENT EXPANDED PROTECTIONS FOR SURVIVORS OF DOMESTIC VIOLENCE. - U.S. Housing and Urban Development (HUD) Secretary Julián Castro today announced a new proposed rule to increase protections for domestic violence survivors. The rule would implement the Violence Against Women Reauthorization Act of 2013 (VAWA 2013), which expands HUD’s authority to protect survivors of domestic and dating violence, stalking, and sexual assault who are residing in housing assisted by HUD. 60-Day Notice of Proposed Information Collection: Public Housing Agency Executive Compensation Information: HUD collects information on the compensation provided by public housing agencies (PHAs) to the top management official, top financial official, and highest compensated employee, similar to the information that non-profit organizations receiving federal tax exemptions are required to report to the IRS annually. Because PHAs receive significant direct federal funds HUD has been collecting compensation information to enhance regulatory oversight by HUD, as well as state and local authorities. HUD provides the information collected to the public. The compensation data collected includes base salary and bonus, and incentive and other compensation, and the extent to which these payments are made with federal funds. Minor formatting changes were made to the HUD form 52769 (ROSS SERVICE COORDINATORS—NEEDS and SERVICE PARTNERS). The FSS Funding Request form (Form 52651) was removed from the collection. 30-Day Notice of Proposed Information Collection: Inspector Candidate Assessment Questionnaire. To meet the requirements of the Uniform Physical Condition Standards (UPCS), the Physical Condition of Multifamily Properties and the Public Housing Assessment System (PHAS) rules, the Department conducts physical condition inspections of approximately 14,000 multifamily and public housing properties annually. To conduct these inspections, HUD uses contract inspectors that are trained and certified in the Uniform Physical Condition Standards protocol by HUD. Individuals who wish to be trained and certified by HUD are requested to electronically submit the questionnaire via the Internet. The questionnaire provides HUD with basic knowledge of an individual’s inspection skills and abilities. As part of aligning REAC inspections, state Housing Finance Agencies may also fill out the form for informational purposes only. Comments Due Date: April 6, 2015

The information provided by the eligible applicants will be reviewed and evaluated by HUD. 60-Day Notice of Proposed Information Collection: Family Unification Program. The Family Unification Program (FUP) is a program, authorized under section 8(x) of the United States Housing Act of 1937 (42 U.S.C. 1437(X), that provides housing choice vouchers to PHAs to assist families for whom the lack of adequate housing is a primary factor in the imminent placement of the family’s child or children in out-of-home care; or the delay in the discharge of the child, or children, to the family from out-of home care. Youths at least 18 years old and not more than 21 years old (have not reached 22nd birthday) who left foster care at age 16 or older and who do not have adequate housing are also eligible to receive housing assistance under the FUP. As required by statute, a FUP voucher issued to such a youth may only be used to provide housing assistance for the youth for a maximum of 18 months. Vouchers awarded under FUP are administered by PHAs under HUD’s regulations for the Housing Choice Voucher program (24 CFR part 982). Information about this program can be found here.
