State and Tribal Programs

State Program Amendments

State regulatory program laws and regulations must be as effective as the requirements of SMCRA and Federal Rules. States cannot implement law and rule changes until they are approved by OSM. OSM reviews every informal and formal submission of proposed amendments to the States' regulatory programs. Public comments are requested and considered on all such program changes. The public can view or comment on any formally proposed amendment online by visiting www.regulations.gov. After OSM has evaluated the amendment proposal, a decision document is published in the Federal Register approving or disapproving the State program amendment. The Denver Field Division (DFD) is responsible for processing all amendments in the Western Region.
