BSEE Issues Incidents of Noncompliance for Fatal Crane Accident

February 5, 2013- The Bureau of Safety and Environmental Enforcement (BSEE) today issued three Incidents of Non-Compliance (INC) based on the findings of a BSEE accident investigation panel concerning a fatal crane accident that occurred on August 16, 2011, on the offshore production platform, High Island A557 “A”. The INCs were issued to Energy Resource Technology GOM, Inc. (ERT GOM Inc.), the operator of the platform.

The INCs issued today address violations of specific federal regulations. BSEE’s Enforcement Program allows for a 60-day appeal period. The INCs will also be reviewed for possible imposition of civil penalties.

The following is a listing of the federal regulations and the specific INCs issued to ERT GOM Inc.:

INCs issued to ERT GOM, INC. 

30 CFR 250.401(e) – ERT GOM Inc. failed to perform all operations in a safe and workmanlike manner to provide for the preservation and conservation of property and the environment.

30 CFR 250.401(e) – ERT GOM Inc. failed to maintain all equipment in a safe condition to provide for the protection of the lease and associated faciltiies.

30 CFR 250.108 – ERT GOM Inc. failed to perform a pre-use inspection in accordance with API RP 2D, Paragraphs 4.1.1.1 and 4.1.2.2.
