This table includes a collection of significant enforcement actions (referred to as "escalated") that the NRC has issued to materials licensees.
The types of actions and their abbreviations are as follows:
- Notice of Violation for Severity Level I, II, or III violations (NOV)
- Notice of Violation and Proposed Imposition of Civil Penalty (NOVCP)
- Order Imposing Civil Penalty (CPORDER)
- Order Modifying, Suspending, or Revoking License (ORDER)

08/16/2007 | On August 16, 2007, a Notice of Violation (NOV) and Proposed Imposition of Civil Penalty in the amount of $3,250 was issued for a a Severity Level III violation of 10 CFR 30.34(i) involving the failure to maintain a minimum of two independent physical controls that formed tangible barriers to secure a portable gauge from unauthorized removal during a period when the portable gauge was not under the control and constant surveillance of the licensee, which may have contributed to the theft of the gauge. Specifically, a portable nuclear gauge was stolen from an unattended licensee vehicle that was parked at an employee residence. While the gauge was unattended, the licensee had only a single tangible barrier in place to prevent the theft. |

10/21/2009 | On October 21, 2009, the NRC issued a Notice of Violation to Virtua Health System - West Jersey Hospital (Virtua) for a Severity Level III violation involving the failure to develop, implement, and maintain written procedures to provide high confidence that each administration is in accordance with the written directive, as required by 10 CFR 35.41(a)(2). Specifically, during patient setup on January 19, 2009, Virtua staff raised questions concerning the visualization and positioning of seeds in the prostate and there were no procedures to ensure resolution of the questions. As a result, all seeds were implanted outside the prostate. |
