Determination and Policy Letters

Business activities of Fannie Mae and Freddie Mac (the Enterprises) must be in compliance with the Enterprise charter provisions and public purposes.  The charter compliance responsibilities of the Department of Housing and Urban Development (HUD) under the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (FHFSSA) were transferred to the Federal Housing Finance Agency (FHFA) under the Housing and Economic Recovery Act of 2008 (P.L. 110-289), enacted July 30, 2008.  On March 16, 2009, the Senior Deputy Director for Housing Mission and Goals sent letters to the Enterprises informing them that the low- and moderate-income goal, the special affordable goal, and the three home purchase subgoals for 2008 were infeasible.

Historically, HUD reviewed certain activities of the Enterprises, as well as specific issues related to counting mortgages and dwelling units for credit towards the housing goals and issued determination letters and policy guidance to the Enterprises.  The letters included below represent some of the key issues addressed by HUD. When HUD determined information to be proprietary or confidential, pursuant to Section 1326 of FHEFSSA ("Prohibition of Public Disclosure of Proprietary Information" (12 U.S.C. § 4546)) and HUD's regulations regarding the handling of confidential and proprietary information (24 C.F.R. §§ 81.73-81.77), that information has been redacted.
