PRIVACY ACT (PA) REFERENCE GUIDE
The Privacy Act of 1974 provides safeguards against unwarranted invasions of privacy and disclosure of information stemming from a Federal agency’s collection, maintenance, use and disclosure of personal information. The Privacy Act restricts disclosure of personally identifiable records maintained by an agency; grants an individual a right of access to records maintained by the agency; grants an individual the right to seek amendment of agency records maintained about that individual upon a showing that the records are not accurate, relevant, timely, or complete; and establishes a code of “fair information practices” that requires an agency to comply with statutory norms for collection, maintenance, use and dissemination of records.
The OFHEO regulation that implements the Privacy Act is found at part 1702 of Title 12 of the Code of Federal Regulations. OFHEO’s Privacy Act systems of records notices are available electronically at:

Requesting documents under the Privacy Act
The Privacy Act only applies to records about individuals maintained by Federal agencies. It applies to these records only if they are in a “system of records” which means they are retrieved by an individual’s name, Social Security Number, or some other personal identifier. If you are interested in more details, you should read the Privacy Act in its entirety. The full text of the Privacy Act is available on the Department of Justice’s website at http://www.usdoj.gov/foia. Click on “Reference Materials” and scroll down to the “Text of the Privacy Act.”
