Vendor Disqualifications

Vendors may be disqualified from the WIC program for failing to comply with the Vendor Agreement, policies, procedures, and/or USDA federal regulations. Policy WV: 1.0, Contract Policy Violations, (46K, PD) viewing information.

The severity and nature of the violation, and the number of violations determines the length of the vendor disqualification. For specific violations, the state agency reserves the right to offer a civil money penalty (CMP) on a vendor in lieu of disqualification.

Any vendor disqualified from WIC may be disqualified from the Food Stamp Program. Disqualification from the Food Stamp Program will result in automatic disqualification of the same duration from the WIC program.

Vendors who are being disqualified will be notified in writing, at least fifteen (15) days prior to the disqualification date. Rule, 25 TAC, §31.36 allows vendors to formally appeal any adverse action affecting participation. A request for a fair hearing may be request via this web site.
