    The Commission has received a petition from the Dow Chemical Corporation (Dow) requesting approval of certain amendments to the “Ineos Agreement,” which is incorporated into the decision and order allowing the 2001 merger of Dow and Union Carbide. The Commission has approved a final consent order addressing only the claims relating to Count III of the Complaint in the matter concerning Evanston Northwestern Healthcare Corp., et al. The Commission’s Bureau of Consumer Protection has launched a new section on the FTC’s Web site devoted to Project Scofflaw, which tracks offenders that have violated prior Commission orders.

    The Commission has authorized the staff to file an amended complaint in the case currently pending against CHK Trading Corp., et al. (CHK). The staff of the Bureau of Competition has advised Stevens Hospital, in Edmonds, Washington, that its purchase of pharmaceuticals to be dispensed to patients treated by its clinic physicians is covered by the Non-Profit Institutions Act (NPIA). The Commission has approved the publication of a Federal Register notice concerning a new FTC publication incorporating model forms and procedures for identity theft victims, as required by the Fair and Accurate Credit Transactions Act (FACTA).

    In response to a request from California Assembly Member Greg Aghazarian, FTC staff have commented on a bill (AB 1960) that requires pharmacy benefit managers ("PBMs") to disclose certain information to purchasers and prospective purchasers of their services, as well as to prescribers and consumers.

The Commission has authorized the staff to file an amicus curiae brief in Teva Pharmaceuticals USA v. Pfizer, Inc., Case No. 04-1186.
