Definition

The Freedom of Information Act [40 Code of Federal Regulations Part 2 - Public Information] and [5 United States CodeSection 552] provides specifically that "any person" can make requests for government information.  Citizens who make requests are not required to identify themselves or explain why they want the information they have requested.  All branches of the Federal government must adhere to the provisions of FOIA with certain restrictions for work in progress (early drafts), enforcement confidential information, classified documents, and national security information.

40.01     Freedom of Information Act (FOIA) Request

A FOIA request is a written request received by the U.S. Environmental Protection Agency (EPA) from any individual or entity requesting records including databases in the possession or control of the agency.  The EPA has records and data pertaining to human health and the environment.   Letters, faxes and e-mails are all considered to be written requests.  NOTE:   With approval from the site attorney or enforcement officer, refile FOIA correspondence between PRPs, attorneys for PRPs, or owner/operators that has been in the FI file for more than three years, in the appropriate PRP file in the Enforcement, PRP Specific (NP) phase.

FOIA requesters may appeal the denial of information within 30 calendar days from the date of the initial denial letter. Appeals should state the reasons why the requested information should be released under the Act; and why the denial may be in error.  The original FOIA request and response letter should accompany the appeal letter.
