Environmental Guidance | Food Contact Substance Program
The following inventory lists notifications allowed to become effective, which are agency actions of a type requiring environmental consideration. Each listing of an effective notification comprises the Food Contact Notification (FCN) number, the corresponding food contact substance (FCS) using an abbreviated identity, and the environmental requirement and decision. Additional details about the listed FCNs, giving the intended uses, the notifiers and manufacturers, and any specifications or limitations are available on the Inventory of Effective Food Contact Substance Notifications page.
To meet FDA's environmental requirements under the National Environmental Policy Act (NEPA), an FCN must contain an environmental assessment (EA), unless the proposed action is one of a specific class that qualifies for exclusion under 21 CFR 25.32. For specific guidance on the data and information recommended for inclusion in a food contact substance notification, potential notifiers should consult the Food Contact Substance Program page. If the Agency determines that information in an EA supports a decision that no significant environmental impacts are expected, then the Agency prepares a FONSI (Finding of No Significant Impact). If evaluation of data or information in an EA or in other sources available to the Agency leads to a finding that a proposed action may significantly affect the quality of the human environment, then the Agency prepares an EIS (Environmental Impact Statement). Also, the Agency prepares supplements to EAs and to claims of categorical exclusions that were submitted by industry if more evidence is needed to support a decision.

Cat Ex Memo | Categorical Exclusion Memo. These memoranda simply state only that a claim cites the section under which a categorical exclusion is applicable, states compliance with the categorical exclusion criteria, and states that no extraordinary circumstances exist that require the submission of an environmental assessment. Therefore, these memoranda are not included in the inventory unless the Cat Ex memo contains additional information. |

For those instances when FDA has prepared an EA for a submission, the EA has been included with the FONSI in the "FDA Decision" column. Not all environmental documents have been included. In order to help reduce processing time and costs, some documents may not be displayed in this inventory because a preliminary review of those records indicated that the information is not required to be publicly disclosed.
