Crower Sales and Engineering is an auto parts maker. Ortho Organizers makes orthodontic steel brackets. Flash Electronics puts electronic parts onto circuit boards. What do these California companies have in common? They all generate large quantities of hazardous waste, which requires them to file a hazardous waste report, called a Biennial Report, every two years
Whether these are Fortune 500 companies or just neighborhood mom-and-pop shops, making sure they report their hazardous waste is important to residents of nearby communities who want to know what’s in their back yards.
EPA estimates that the United States generates 41 million tons of hazardous waste annually. EPA uses the Biennial Reports to track changes in waste volume and toxicity, the effects of regulations, and the impact of pollution-prevention and waste-minimization efforts. This information gives EPA a clearer picture of what types of waste end up in landfills, which can lead to regulatory changes to enhance recycling and can affect decisions on the siting of hazardous waste facilities. The Biennial Reports are essential to EPA’s mission of protecting public health and the environment.
Some types of hazardous waste can be dangerous even in very small amounts. EPA requires Biennial Reports from any facility that generates more than 2.2 pounds of acutely hazardous waste, or 2,200 pounds of other hazardous waste, per month. About 2,500 facilities in California are required to file reports to EPA every other year on the quantities, nature, and disposition of their hazardous wastes.
Recently, in an effort to increase compliance with these requirements, EPA’s Pacific Southwest Regional Office initiated a new expedited settlement program for large quantity hazardous waste generators that failed to file their 2001 biennial reports. The move came after EPA discovered that numerous facilities that should have filed biennial reports had failed to do so.
In the pilot program, EPA targeted 45 large hazardous waste generators who failed to file the report in 1999 and 200l. To date, 31 companies have settled cases with EPA and reported more than 36 million pounds of hazardous waste. In addition to providing their missing biennial hazardous waste reports, each company paid a fine of $2,200.
EPA’s Pacific Southwest Regional Office plans to expand this effort based on 2003 biennial reports, and extend it to Arizona, Nevada, Hawaii and the Pacific Islands.
