EPA Assistance Agreement Requirements
Find information on EPA grant regulations, policies and guidance. Listed below are the EPA regulations, orders, and policies for reviewing and administering EPA grants.
- 40 C.F.R. Part 31
This part establishes uniform administrative rules for Federal grants and cooperative agreements and subawards to State, local and Indian tribal governments.
- 40 C.F.R. Part 35, Subpart B
This subpart establishes administrative requirements for all grants awarded to Indian tribes and Intertribal Consortia for the environmental programs listed in §35.501. This subpart supplements requirements in EPA's general grant regulations found at 40 CFR part 31.
- Policy for Competition in Assistance Agreements: 5700.5A1
It is EPA policy to promote competition in the award of assistance agreements to the maximum extent practicable. When assistance agreements are awarded competitively, it is EPA policy that the competitive process be fair and open and that no applicant receive an unfair competitive advantage.

- Purchasing Supplies, Equipment, and Services Under EPA Grants Local Governments
Recipients of EPA grants and cooperative agreements, will likely need to buy supplies, equipment, and services to complete the project. This guidance will help you meet EPA requirements when making such necessary purchases.
- Lobbying (Anti-Lobbying) (40 CFR Part 34)
Recipients of Federal grants, cooperative agreements, contracts, and loans are prohibited by 31 USC 1352, "Limitation on Use of Appropriated Funds to Influence Certain Federal Contracting and Financial Transactions," from using Federal (appropriated) funds to pay any person for influencing or attempting to influence any officer or employee of an agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress with respect to the award, continuation, renewal, amendment, or modification of any of these instruments.
- Drug-Free Workplace (40 CFR Part 36)
The Drug-Free Workplace Act of 1988 (Public Law 100-690, Title V, Subtitle D, as amended) requires that all organizations receiving grants from any Federal agency agree to maintain a drug-free workplace. Under this law, employees of grantees are prohibited from engaging in the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance at work.
Minority Business Enterprise/Women’s Business Enterprise (MBE/WBE)
- MBE/WBE programs
The policy goal of the MBE/WBE Programs is to assure that minority business enterprises (MBE) and woman business enterprises (WBE) are given the opportunity to participate in contract and procurement for supplies, construction, equipment and services under any EPA grant or cooperative agreement. The Policy applies to all contracts/procurement for supplies, construction equipment and services under any EPA grant or cooperative agreement.
- EPA Policy on Assessing Capabilities of Non-Profit Applicants for Managing Assistance Awards, [EPA Order 5700.8], (PDF)
This Order establishes internal controls for determining the administrative and programmatic capability of non-profit organizations applying for EPA assistance agreements. This Order also enhances post-award oversight by requiring EPA award officials to take appropriate remedies against non-profit recipients that materially fail to comply with the terms and conditions of assistance agreements.
- EPA’s Debarment and Suspension Program
EPA’s management authority include effective administrative tool to address waste, fraud, abuse, poor performance, environmental noncompliance or other misconduct … the authority to suspend and or debar individuals and entities. Suspension and Debarment actions prevent companies and individuals from participating in government contracts, subcontracts, loans, grants and other assistance programs.

Federal Statutes
Federal Grants and Cooperative Agreements Act (FGCAA) of 1977 (31 U.S.C. §§ 6301-6308)
FGCAA establishes government-wide standards for agencies to use in selecting the most appropriate funding instrument - procurements contracts, grants, or cooperative agreements.
Requires government agencies to set program goals, evaluate performance based on those goals, and report on the results of that evaluation to Congress. The results are part of the budgetary decision-making process.
Single Audit Act of 1984 and Amendments of 1996 (31 U.S.C. § 7501 et seq.)
Establishes uniform audit requirements for state, local, and Indian tribal governments. A single or program-specific audit is required of non-federal entities spending $500,000 or more in a year in federal awards.
Federal Administrative Requirements
The Office of Management and Budget (OMB) issues government-wide circulars for managing grants that apply to all Federal executive agencies. When these agencies are required to apply the directives, the effect on grantees is often the same as regulation. Among the circulars relevant to grants administration are those that have to do with administrative requirements, cost principles, and audits.
