Federal Activities Inventory Reform Act of 1998 (FAIR)

On October 19, 1998, President Clinton signed into law the “Federal Activities Inventory Reform Act of 1998” (FAIR Act). The FAIR Act directs Federal agencies to identify their activities that are performed by Federal employees but that are not inherently Governmental (such as commercial activities). Dear Mr. Daniels:

In accordance with the FAIR Act, P.L. 105-270, on behalf of the Institute of Museum and Library Services (IMLS) I am pleased to submit this report on agency performance of commercial activities.

We believe that all of the current activities performed by IMLS are inherently governmental activities. As such, there are no in-house activities that produce a product or service that could be obtained from a commercial source. IMLS contracts with other federal agencies for certain services described in A-76 as meeting the criteria of potentially commercial services, such as building security and maintenance, payroll, automatic data processing, and telecommunications systems. In all other areas, IMLS utilizes commercial sources to supply needed products and services wherever possible in order to maximize resources available to the government. Because inherently government functions are exempt, the Institute of Museum and Library Services does not perform commercial activities to report at this time.
