Contact: Office of Nuclear Reactor Regulation (NRR) Regulatory Issue Summary (RIS) 2008-21, Issuance of LIC-109, “ACCEPTANCE REVIEW PROCEDURE,” Issued On September 2, 2008, the staff issued RIS 2008-21, ISSUANCE OF LIC-109, “ACCEPTANCE REVIEW PROCEDURES.” The NRC is issuing this regulatory issue summary to inform addressees of the issuance of a new procedure (LIC-109, “Acceptance Review Procedures”) within NRR regarding acceptance reviews. LIC-109 prescribes timeliness for the staff’s performance of the acceptance review and promotes consistency in the criteria against which the staff will evaluate a requested licensing action to determine its acceptability for review. NRC Draft Regulatory Issue Summary (RIS) Public Meeting On September 3, 2008, the staff met with NEI in a Category 2 Public Meeting to discuss draft RIS, “Staff Position on Extension of the Containment Type A Test Interval Beyond 15 Years under Option B of Appendix J to 10 CFR Part 50.” The staff agreed to consider the comments received from NEI regarding the language of the examples of justifications citied in the RIS. Onsite Audit of the Aging Management Program of Prairie Island Nuclear Generating Plant, Units 1 and 2 During the week of September 8, 2008, the staff performed an onsite audit at Prairie Island Nuclear Generating Plant, Units 1 and 2 ( Prairie Island) in support of the staff’s review of the Prairie Island license renewal application. The on-site audit focused on the applicant’s aging management programs which are required to demonstrate whether the effects of aging will be adequately managed during the period of extended operation. While onsite, the staff reviewed the applicant’s documents and interviewed applicant staff. The applicant's management was briefed on the results of the audit at the exit conducted on September 11. Generic Fundamentals Examination (GFE) On September 10, 2008, NRC successfully administered the GFE to 152 license operator applicants in 17 utilities across all four Regions. The GFE measures applicant knowledge in components, reactor theory, and thermodynamics, and is the first examination that license operator applicants must take and pass before they can proceed to their site-specific training and subsequently take the NRC site-specific license examination. Meeting with Boiling Water Reactor Owners Group (BWROG) on Suction Strainer Activities On September 10 and 11, 2008, the staff met with BWROG to discuss their activities relating to suction strainers at BWRs. For the September 10, 2008, meeting with senior NRC management, the BWROG described their plans, including their expected timeline of activities for investigating and addressing any identified issues associated with BWR suction strainers over a 3-year period. The September 11, 2008, meeting with the NRC technical staff focused on the BWROG’s plans related to in-vessel downstream effects; specifically on coolant blockage due to debris, cladding deposition, and effects on peak cladding temperature. It was agreed that the BWROG should continue to interact with the staff (e.g., provide their plans and walk down guidelines) so that potential issues can be identified and resolved as early in the process as possible. Office of New Reactors (NRO) Vendor Inspection at Enertech Brea, California Facility From September 15 through 18, 2008, staff conducted an inspection at the Enertech facility located in Brea, California. Enertech is a Division of Curtiss-Wright Flow Control and is a major supplier of safety-related ASME Code valves, safety-related pumps (including spare parts, upgrades, maintenance, etc.), large bore and pipe support snobbery, pneumatic actuators, motors, safety-related instrumentation, diagnostic and test equipment, and service, repair, and engineering services to the nuclear power industry. Memorandum of Understanding (MOU) Signed With Army Corps of Engineers (Corps) On September 12, 2008, the NRC and the Corps signed an MOU which establishes a framework for early coordination and participation among the agencies to facilitate the timely review of proposed nuclear power plant applications. The MOU establishes a commitment to early agency involvement; proactive participation and informal communication throughout the review process; sharing of information gathered, considered and relied upon by each agency; and, if requested, interagency participation in public hearings. Office of Federal and State Materials and Environmental Management Programs (FSME) Public Meetings Held on Uranium Milling Draft Generic Environmental Impact Statement On September 8, 9, and 11, 2008, staff held public meetings in Gallup, Grants, and Albuquerque, New Mexico. The purpose of these meetings was to discuss and accept public comments on the draft Generic Environmental Impact Statement for Uranium Milling Facilities (Draft GEIS). The Draft GEIS was made available for public comment on July 28, and the public comment period is scheduled to close on October 7. Low-Level Waste Forum On September 11 and 12, 2008, staff made presentations at the Low-Level Waste (LLW) Forum meeting in Annapolis, Maryland. The LLW Forum facilitates State and Interstate compact implementation of the Federal Low-Level Radioactive Waste Policy Amendment Act. It also fosters information sharing among State, Compact, and Federal officials. Commissioner Jaczko, as well as several Congressional staff members, also made presentations on LLW-related issues. Office of Nuclear Regulatory Research (RES) Publication of Draft Regulatory Guide 3031 (DG-3031), “Standard Format and Content for the Health and Safety Sections of License Renewal Applications for Uranium Processing and Fuel Fabrication” On September 9, 2008, the staff issued the subject DG to provide an opportunity for public comment. This is proposed Revision 1 to Regulatory Guide 3.52, which endorses NUREG-1520 as an acceptable format and content for license renewal applications for fuel cycle facilities. Publication of Draft Regulatory Guide 0020 (DG-0020), “Guide for the Preparation of Applications for Licenses to Process Source Material” On September 10, 2008, the staff issued the subject DG to provide an opportunity for public comment. This is proposed Revision 3 to Regulatory Guide 10.4, which endorses NUREG-1556 as an acceptable method of applying for a license to process source material, or requesting a revision to a source material processing license. Office of Nuclear Security and Incident Response (NSIR) Potassium Iodide Distribution On September 10, 2008, NRC accepted the offer from the Department of Health and Human Services (HHS) for the transfer of HHS’ potassium iodide tablets to the NRC. NRC will send the tablets to the Commonwealth of Pennsylvania as part of the replenishment of existing State stockpiles. Office of Administration (ADM) Criminal Penalties; Unauthorized Introduction of Weapons (RIN3150-AI31, 10 CFR Part 73) On September 3, 2008, the NRC published a document (73 FR 51378) in the Federal Register proposing to amend its regulations to authorize the imposition of Federal criminal penalties on those who, without authorization, introduce weapons or explosives into specified classes of facilities and installations subject to the regulatory authority of the NRC. This action is necessary to implement Section 229, “Trespass on Commission Installations” of the Atomic Energy Act of 1954, as amended. The comment period for the proposed rule closes on October 20, 2008. Amendment to 10 CFR 50.55 On September 10, 2008, the NRC published a final rule in the Federal Register to amend 10 CFR 50.55a to incorporate by reference the 2004 Edition of Division 1 of Section III of the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code; the 2004 Edition of Division 1 of Section XI of the ASME BPV Code; and the 2004 Edition of the ASME Code for Operation and Maintenance of Nuclear Power Plants (OM Code). These ASME Codes provide requirements for constructing and inspecting components and testing pumps and valves in light-water nuclear power plants. This action is in accordance with the NRC’s policy to periodically update § 50.55a to incorporate new editions and addenda of the ASME Codes by reference. Office of Information Services (OIS) Video: Inside the NRC Posted to Public Website On September 8, 2008, the NRC posted the video Inside the NRC to the Public Website under About NRC. The video was requested by the Office of Public Affairs to inform the public about the history of the NRC from its inception as the Atomic Energy Commission. Protection of High Risk Information Meeting On September 10, 2008, staff attended a meeting of the local Gaithersburg Chapter of the Association of Records Managers and Administrators International. Presentation topics included protecting high-risk information and how to combine a comprehensive information mapping process with a risk-based scoring framework. This will help identify and prioritize information systems across the enterprise in order to enable an organization to identify where high-risk data resides and how well it is managed. OPA supported an interview between NRC Chairman Klein and the Associated Press while on campus at the University of Illinois at Urbana-Champaign, covering topics on new reactors, security and workforce development.
