Pesticide Establishment Registration and Reporting

FIFRA Topics

Establishments that produce pesticides, active ingredients or devices, including companies or establishments that import into the United States, must register and file production reports with EPA. The Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) requires that production of pesticides or devices (PDF) (479K, 3 pp, About PDF) be conducted in a registered pesticide-producing or device-producing establishment. ("Production" includes formulation, packaging, repackaging, and relabeling.) Production in an unregistered establishment is a violation of the law. Information on pesticide establishments is tracked through the Section Seven Tracking System.

The following questions and answers explain the requirements for pesticide establishment registration and reporting. For more information, contact the pesticide establishment coordinator in your area or refer to FIFRA § 7 and 40 C.F.R. Part 167.

Registering an Establishment

EPA assigns a unique number to each establishment that produces any pesticide or device. Each company must submit EPA Form 3540-8 to request an establishment number. FIFRA requires that each producing establishment must place its EPA establishment number on the label or immediate container of each pesticide, device or active ingredient produced.

The form below can be completed electronically and reset to add to the establishments section while standard fields remain the same.

The EPA Form 3540-8 (PDF) (59K, 1 p, About PDF) contains registration information such as:

NOTE: EPA will not accept any faxes or emails of establishment registration forms (EPA Form 3540-8).

Filing an Initial or Annual Report

An initial report on EPA Form 3540-16 (PDF) (551K, 1 p, About PDF) is due to EPA 30 days after the company is notified of their pesticide-producing or device-producing establishment number. Instructions for form 3540-16 (PDF) (79K, 8 pp, About PDF)

Each facility that produces pesticides or devices must submit a report to EPA by March first each year. The report includes:

Foreign establishments that import pesticides or devices to the United States must also submit a report to EPA. The amount reported should only be that amount which is imported into the United States, not to other countries.

Failure to file an initial and annual production report is a violation of FIFRA, and may result in termination of the establishment’s registration, civil penalties up to $6,500 per violation or criminal penalties. In addition, it is unlawful to knowingly falsify all or part of any pesticide production information reported on EPA Form 3540-16.

NOTE: EPA will not accept any faxes or emails of establishment initial or annual reports (EPA Form 3540-16).
