Summary: |
The Department has proposed a rulemaking that will require all cage-produced eggs sold in the state to be certified by the United Egg Producers (UEP) and to indicate said certification on all egg containers. Additionally, all cage-use egg-producers in the state with more than 20,000 egg laying hens will also have to be certified by the UEP and comply with federal sanitary conditions.

Plant Services Division – Lettuce Mosaic |
Summary: |
The Department has drafted a rule to address concerns regarding lettuce mosaic virus. The draft rule would in sum do the following:
- Create a definition for breeder seed.
- Redefine “mosaic-indexed” to require laboratories that index lettuce seed for shipment to Arizona be certified by the agricultural department of the laboratory’s state of origin or by the Department, as provided by A.R.S. § 3-145, or accredited by the National Seed Health System.
- Broaden the area the Department considers to be under quarantine for lettuce mosaic to include territories of the United States.
- Exempt from the permitting process breeder seed used for seed trials on plots up to 1.25 acres, with provisions for addressing plants if they exhibit symptoms.
- Broadens the permit section to allow a person to ship unindexed lettuce seed to Arizona so that it may be mosaic-indexed.

Animal Services Division – Trichomoniasis |
Summary: |
The Department is proposing to amend its rules dealing with importation of cattle and bison to take stronger measures to prevent the spread of Trichomoniasis in Arizona. The proposed rules require bulls to test negative for Tritrichomonas foetus and that they not engage in breeding activities between the time of testing negative and the time they are imported. Health certificates must also affirm this. Lastly, test samples must be collected by an accredited veterinarian and tested at an approved laboratory. |

Animal Services Division – Health Admission of Animals |
Summary: |
The Department of Agriculture is amending its rules dealing with the admission of animals, following a five-year rule review. Many of these amendments are meant to make the rule more understandable and will have very little impact. However, the Department is also amending the rule to require that an official eartag for dairy cattle also include information that identifies the cattle’s herd of birth. The Department also proposes to amend the rule to require a health certificate or Form 9-3 from the National Poultry Improvement Program before allowing poultry animals into the state. |

Summary: |
The Department is proposing to amend its rules dealing with native plants. The Department is resubmitting the proposal from earlier this year so that it may provide due notification to interested stakeholders. The Department is substantively amending its process for issuing permits to move native plants, including new permit fees, a more understandable permitting process, and a procedure for those who wish to donate native plants. |
