    Other Types of Filings

    As part of its ongoing oversight of market-based rate authorizations and market conditions the Commission requires all market-based rate sellers to:

    • Electronically submit Electric Quarterly Reports consistent with the procedures the Commission adopted in Order No. 2001 PDF (Revised Public Utility Filing Requirements, Order No. 2001, 67 Fed.Reg. 31043, FERC Stats. & Regs.¶ 31,127 at P 11-12, 18-21 (April 25, 2002), reh'g denied, Order No. 2001-A, 100 FERC ¶ 61,074, reconsideration and clarification denied, Order No.2001-B, 100 FERC ¶ 61,342, order directing filings, Order No. 2001-C, 101 FERC ¶ 61,314 (2002)).


    • File Notices of Change in Status consistent with Order No. 652 PDF to report any changes in the facts relied upon by the Commission when granting market-based rate authority, including the acquisition of generation or transmission and the affiliation with any entity owning or controlling such assets (Reporting Requirement for Changes in Status for Public Utilities with Market-Based Rate Authority, Order No. 652, 70 Fed. Reg. 8,253 (Feb. 18, 2005), FERC Stats. &Regs. ¶ 31,175, order on reh'g, 111 FERC ¶ 61,413 (2005)).


    • Notify the Commission of seller name changes, if the seller merges with another entity, or has its tariff adopted by another entity (18 C.F.R. § 35.16, Notices of Succession).


    • Notify the Commission if the seller desires to cancel its tariff (18 C.F.R. § 35.15, Notices of Cancellation or Termination).


    • Notify the Commission if any officers or directors are (a) an officer or director of more than one public utility, (b) an officer or director of a public utility, any bank,trust company, banking association, or firm that is authorized by law to underwrite or participate in the marketing of securities of a public utility, or (c) an officer or director of a public utility and of any company supplying electrical equipment to a public utility.     In addition, all market-based rate sellers are required to pay annual charges pursuant to 18 C.F.R § 382.
