Office of the Benefits Tax Counsel

The Office of the Benefits Tax Counsel (BTC) develops and reviews policy, legislation, regulations, and revenue rulings dealing with all aspects of employee benefits taxation and related matters including qualified retirement plans, Employee Stock Ownership Plans, employee welfare plans, health and long term care benefits, social security taxes, and executive compensation.

BTC is responsible for advising the Assistant Secretary (Tax Policy) and other Treasury officials in the formulation of the Administration's employee benefits taxation policy: for formulating, analyzing, and reviewing employee benefits taxation legislation and for preparing the Administration's testimony on such legislation. BTC assists Congressional staff in drafting legislation and in documenting the legislative history of employee benefits legislation.

In consultation with IRS, BTC is responsible for review of all Treasury regulations and IRS revenue rulings relating to the taxation of employee benefits. Such regulations and rulings play a crucial role in the development of tax policy and implementation of tax law.
