Q: D. What rules apply to appeals of FERC cases?
A: The Federal Rules of Appellate Procedure apply to petitions for review of Commission orders in the U.S. Courts of Appeals. Each Court of Appeals has local rules that must be followed as well. Both sets of rules can be found in Title 28 of the U.S. Code. In addition, the judicial review provisions of the statutes the Commission administers govern review of Commission orders. See Natural Gas Act 19, 15 U.S.C. § 717r (1994); Natural Gas Policy Act § 516, 15 U.S.C. § 3416 (1994); Federal Power Act § 313, 16 U.S.C. § 825l (1994); see also 28 U.S.C. § 2321(a)(1988) (judicial review under the Interstate Commerce Act).
