Lawful Placement Verification

NIH requires that all contract employers prepare an employer letter that attests to the fact that placement of its employee at NIH does not violate the terms and conditions of the non-immigrant status under which the employee is authorized to work in the U.S.

The employer letter must be printed on official letterhead, dated, signed by the employer representative or visa sponsor authorized to sign immigration documents, and contain the following information:

  1. Full legal name of the contract employee (as it appears on his or her passport)
  2. Current non-immigrant status (H-1B, J-1, J-2 with EAD, O-1, etc.)
  3. Full name of the contract employer, including abbreviation or acronym
  4. Begin and end dates of placement and number of hours per week
  5. Title, address, phone, fax, and email of the authorized signer

For your convenience, we have provided a sample letter and a fillable template to assist in drafting the letter. Contract employees must submit an original copy of this letter to DIS at the time they report to DIS for clearance.
