DCL-08-40, Tribal Child Support Enforcement Programs

The Office of Child Support Enforcement (OCSE) has approved funding for a total of 28 Tribal IV-D programs. Please join OCSE in welcoming these new programs.

TDCL-08-04, Submission of Completed OCSE-75 Forms

This DCL is to inform Tribal Child Support agencies that they have ninety days following the end of the federal fiscal year or by December 29th of each calendar year to submit their completed OCSE-75 forms.

TDCL-08-03, Tribal IV-D Child Support Enforcement Computer-Based Training (CBT) Courses

The OCSE has developed five computer-based and web-based training courses targeted for Tribal child support enforcement caseworkers and other interested individuals. The training is organized around procedures in the final rule for Tribal Child Support Enforcement Programs published in the Federal Register on March 30, 2004 (69FR 16638) implementing section 455(f) of the Social Security Act. The five courses are Orientation; Locate; Paternity Establishment; Enforcement; and Intergovernmental Cases.

This TDCL reminds comprehensive Tribal IV-D programs, Tribal IV-D programs with start-up funding, and Tribes applying for Start-up funding that copies of contracts must be submitted with Tribal IV-D plans in accordance with 45 CFR 309.60(c)

The Office of Child Support Enforcement anticipates that the Computerized Tribal IV-D system and Office Automation Notice of Proposed Rule Making will be published soon. In anticipation of the published NPRM, consultations will be held. The dates are noted in the TDCL

The Violence Against Women Act of 1994 amended the United States Code to require State and tribal courts in one jurisdiction to give full faith and Credit to valid protection orders issued by a court in another jurisdiction.

The provision of title IV-D child support services on Tribal Lands can be a challenge for both Indian custodial parents and their children who need child support, and for States who have the duty to administer a Child Support Enforcement program. Under title IV-D of the Act, authority to administer the delivery of support enforcement services lies with the States and their local political instrumentalities. However, on most Indian reservations the authority of State and local governments and the jurisdiction of State law is limited or non-existant.
