DCL-06-20, Update of OCSE's Video on "The Power of Two: Voluntarily Acknowledging Paternity"

The video was originally developed to help states comply with the federal law requiring all unwed mothers and fathers be provided an oral, as well as written, explanation of their legal rights, responsibilities, and consequences of voluntarily signing a paternity acknowledgment. It has become increasingly apparent that, in addition to establishing paternity, one of the best steps parents can take to improve the well-being of children is to raise them in a safe, stable, and healthy environment. The English and Spanish versions of the video have been updated to include the positive aspects for children of healthy marriage and to inform those who think they might be interested in learning more, that marriage education services are available.

A letter from the Health Care Financing Administration (HCFA) to State Medicaid Directors addressing paternity and medical support cooperation requirements for Medicaid applicants and recipients. The SMD letter recognizes the valuable assistance that child support enforcement agencies provide to families, but clarifies that health care access for children is of paramount concern.

In response to the Office of Child Support Enforcement's assessment of State child support enforcement agencies' technical assistance and training needs, States indicated a need for a video they could use to train staff who provided paternity acknowledgment services. This video has been designed for State use in training hospital, vital statistics and other staff who offer parents the opportunity to acknowledge paternity.

On August 3, 1993, the Office of Child Support Enforcement (OCSE) published and distributed the "Directory of Genetic Testing Laboratories, Third Edition" (IM-93-04) to all States. We are planning to publish a revised edition of this Directory. We are requesting your assistance in this effort.

DCL-95-42, States Report Information on In-Hospital Paternity Establishment

This letter is to remind you that the Office of Child Support Enforcement has requested that States report information on their in-hospital paternity establishment program on a voluntary basis. For FY 1994, 7 States submitted reports. In FY 1995, 13 States submitted reports for the first quarter and 10 States submitted reports for the second quarter.

DCL-95-40, Determining Paternity for Children Born Out of Wedlock

This will inform you of a recent Action Transmittal, ACF-AT-95-05 dated May 20, 1995, issued by the Administration for Children and Families, Office of Family Assistance, to provide State agencies with new administrative procedures for use in determining paternity for children born out of wedlock for purposes of meeting the AFDC eligibility requirements. Specifically, in order to be eligible for AFDC, the child must be: (1) deprived of parental support and (2) living with a specified relative of proper degree.

You are aware that the Omnibus Budget Reconciliation Act of 1993 (OBRA `93) and P.L. 103-432, the Social Security Amendments of 1994, modified provisions under the Paternity Establishment Percentage (PEP) formula previously used. Our March 15 Action Transmittal, OCSE-AT-95-04, gave a detailed explanation of the revised standard regarding the method of measuring States` PEP. Finally, the issue of paternity establishment is a focus of significant attention in the major child support enforcement proposals now before the Congress. I would like to thank you for your continued cooperation and your ongoing efforts on behalf of children.

The first publication is entitled In-Hospital Paternity Establishment: A Resource Guide which reflects the results of a meeting convened by OCSE in August, 1993, and the second publication, In-Hospital Paternity Establishment Information Materials, is a compilation of in-hospital paternity related forms and other materials that states have developed to assist them in implementing early paternity establishment programs.

Registration is limited and will be on a first come, first served basis so we urge you to encourage your staff to register as quickly as possible.

DCL-94-02, OBRA 1993--Paternity Establishment Performance Standards

The Omnibus Budget Reconciliation Act of 1993 (Pub. L. 103-66) revised the paternity establishment performance standard which States must meet. A bill proposing technical amendments to OBRA has been introduced in Congress. That bill (S. 1668) contains technical revisions to the paternity standard as enacted in OBRA.
