Request for Public Comment:

February 4, 2008

The Executive Office for U.S. Trustees has issued for public comment a proposed rule setting forth procedures and criteria for the approval of nonprofit budget and credit counseling agencies under 11 U.S.C. § 111. Comments are due by April 1, 2008. Click here for further information.

NOTE: The Interim Final Rule “Application Procedures and Criteria for Approval of Nonprofit Budget and Credit Counseling Agencies and Approval of Providers of the Personal Financial Management Instructional Course by United States Trustees” remain in effect until this proposed credit counseling rule and a future separate proposed debtor education rule are issued. Changes to Waiver of Credit Counseling and Debtor Education Requirements in Areas Affected By Hurricane Katrina:

January 16, 2008

The current waivers for credit counseling and debtor education in the Middle and Western Districts of Louisiana and the Southern District of Mississippi will be terminated effective March 10, 2008, based on a determination that credit counseling and debtor education services are adequate to serve bankruptcy filers in those districts.

The temporary waivers of the credit counseling and debtor education requirements for bankruptcy filers in the Eastern District of Louisiana are extended until further notice.

GAO Report on Credit Counseling and Debtor Education Requirements:

The Government Accountability Office (GAO) issued a report on its study of the implementation of the credit counseling and debtor education requirements under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, including the approval process for providers.
