In a Federal Register notice dated January 24, 2008, "Revisions to the Continuous Emissions Monitoring Rule for the Acid Rain Program, NOx Budget Trading Program, Clean Air Interstate Rule, and the Clean Air Mercury Rule; Final Rule" (73 FR 4364) EPA included provisions relating to and defining a Protocol Gas Verification Program (PGVP). The program as defined in that final rule is "the EPA Protocol Gas audit program described in Section 2.1.10 of the 'EPA Traceability Protocol for Assay and Certification of Gaseous Calibration Standards,' September 1997, EPA-600/R-97/121 (EPA Protocol Procedure) or such revised procedure as approved by the Administrator." As the Administrator has not approved a revised procedure, the currently existing procedure is that described in Section 2.1.10 of the EPA Protocol Procedure which currently provides:

"Periodically, the U.S. EPA will assess the accuracy of compressed gas calibration standards that have been assayed and certified according to this protocol. The accuracy of representative standards will be assessed by EPA audits."

The processes and procedures described in the latest draft Protocol Gas Verification Program Implementation Plan dated February 2008 are not effective and therefore the January 1, 2009, compliance dates referenced in 40 CFR §72.2 and 40 CFR part 75, Appendix A §5.1.4 and discussed in the preamble of the above-mentioned rulemaking do not refer to nor are they effective with respect to the draft PGVP Implementation Plan. A revised procedure will not be effective until EPA goes through notice and comment rulemaking on any revised procedure. Presentation by Sam Napolitano on SO2 and NOx Allowance Markets at the Environmental Markets Association (EMA) Meeting on April 30, 2008 (PDF, 18 pp., 870 KB)

MDC Version 4.2.58 is revised as of May 7, 2008. This version of MDC supersedes, MDC v4.2.57 (posted in May, 2006), and supports the January 24, 2008, revisions to §75.74(c)(2) affecting ozone season only reporters beginning in 2008. This version of MDC also includes other minor fixes to "bugs" and problems that were reported in the previous version. The changes and fixes are detailed in the Release notes for MDC v4.2.58 (PDF) (1 pp., 11 K).

EPA announces the results of the Sixteenth Annual Acid Rain Allowance Auction. The Annual Auction gives power plants, brokers and even private citizens an opportunity to buy and sell sulfur dioxide (SO2) allowances and is part of EPA's highly successful cap and trade program to reduce emissions contributing to acid rain.

Annual reconciliation for the NOx Budget Trading Program (NBP) for the 2007 Ozone Season was completed on February 4, 2008. The allowance transfer freeze for the NBP has been lifted. Complete program information will be published in the NBP Progress Report, expected in July 2008. In the meantime you may access allowance deduction and account holding information via our web query system Data and Maps. Progressive flow control will be in effect for annual reconciliation for the 2008 Ozone Season at a ratio of 0.22.

EPA has posted guidance requesting an alternative submittal deadline for initial monitoring plan and certification applications for CAIR SO2 and CAMR monitoring systems that are due in XML format prior to EPA's ability to accept those electronic files.
