On May17, 2007, the United States District Court for the Western District of North Carolina unsealed a complaint, filed under seal on December 5, 2007, charging Testore with one count of conspiracy (18 U.S.C. § 371), with a telemarketing enhancement (18 U.S.C. 2326).

Testore pled on September 15, 2008. No sentencing date has been set.
