In November 2007, Oregon voters approved Measure 49, which modified Measure 37. The Oregon Department of Land Conservation and Development (DLCD) is authorized under Measure 49 to evaluate existing Measure 37 claims. Measure 37 claims are those claims submitted to the state on or before June 28, 2007. Claims received after June 28, 2007 will be treated as new Measure 49 claims and must be based on land use regulations adopted after January 1, 2007.

DLCD received approximately 4,600 Measure 49 Election Returns at the end of June 2008; the final date by which most returned were due to the department. DLCD began issuing Preliminary Evaluations at the end of July. Final authorizations will be based on the supplemental reviews of Measure 37 claims as allowed under Measure 49.
