FrogWatch USA Data
The following additional terms and conditions apply to your access and use of data or other content made available or which you provide in connection with AZA’s FrogWatch USA citizen science program, whether through the AZA website or the FrogWatch-FieldScope components of the website maintained by the National Geographic Society (all such data and content, “FrogWatch USA Data”).
FrogWatch USA is designed to gather and disseminate information about frog and toad distribution and abundance across the United States. All details of an observation and its associated location (species, call intensity, etc.) are available to all FrogWatch USA users. However, only information pertaining to frog and toad observations is available to users; no personal contact information is ever made public. By voluntarily submitting your information, you acknowledge and agree that AZA retains all right, title and interest in the FrogWatch USA Data (including but not limited to all FrogWatch USA Data that you provide to AZA), and in all copies or derivative works prepared by you. These Terms of Use do not grant you any title or right to any patent, copyright, or other intellectual property rights that AZA may have in the FrogWatch USA Data or that AZA or its partners or others may have in any other works, content or intellectual property associated with the FrogWatch USA citizen science program or the Fieldscope Site or web-based software platform.
The FrogWatch USA Data is provided to users only for applied and basic research and education.
Data is provided by volunteers across the country. In order to recognize the efforts of our dedicated volunteers, users of FrogWatch USA Data shall provide a full and appropriate acknowledgement and citation to AZA in any materials or publications derived in whole or in part from the FrogWatch USA Data. For any publication making substantial use of the FrogWatch USA Data, AZA would welcome the opportunity to comment on the work prior to its publication and to collaborate and co-author the work, if AZA contributes substantial intellectual input in the publication.

For the purposes of these Terms of Use, “commercial purposes” means: (a) any use by, or on behalf of, an entity that operates “for profit”; or (b) any use by any non-profit entity for the purpose of generating revenue.
You agree not to distribute, transfer or otherwise make available original datasets of FrogWatch USA Data to any third parties and will direct all such thirds parties’ requests for use of FrogWatch USA Data to AZA.
You agree not to publish or publicly distribute FrogWatch USA Data in its original format or other works, content or intellectual property associated with the FrogWatch USA citizen science program, either in whole or in part, in any media, including but not limited to on a website, FTP (File Transfer Protocol) site, CD or memory stick.
You may only pass on datasets derived from the original FrogWatch USA Data if such datasets are supplied subject to terms and conditions that are the same as these Terms of Use.
Your use of any FrogWatch USA Data does not constitute an endorsement by AZA of any derived products, reports, or analyses. AZA and FrogWatch USA logos must not be used on any derived products, reports, or analyses, or supporting materials, without the express written consent of AZA.

Miscellaneous
These Terms of Use constitute the entire agreement between you and AZA with respect to this website. Any claim arising out of or relating to this website or these Terms of Use will be settled by individual, binding arbitration in Washington DC in accordance with the commercial arbitration rules of the American Arbitration Association.
