Fact Sheet on Non-Hazardous Secondary Materials Determinations and Scrap Tires

This fact sheet explains how the non-hazardous secondary materials (NHSM) regulations apply to scrap tires and is designed for the regulated community. If a scrap tire is not solid waste, meets the legitimacy criteria, and remains within the control of the generator, it can be burned as a non-waste fuel. If a scrap tire is solid waste, it must be processed in order to be burned as a non-waste fuel.
