Important Note Regarding Use of Application Forms Following Effective Date of Credit Counseling Final Rule
On March 14, 2013, the Credit Counseling final rule was published in the Federal Register. The rule is available on our public website here. This final rule is effective as of April 15, 2013.
Before submitting a first time application, or applying for annual re-approval, each agency and provider must become familiar with these changes and achieve compliance by updating existing procedures, as necessary. Returning applicants should be aware that, in some cases, this means that checking “No Change” on the application will indicate that the applicant is out of compliance with the final rule. Returning applicants should check their responses to the following sections of the application to confirm compliance with the final rule:

The United States Trustee Program has developed a recommended bond form for Nonprofit Budget and Credit Counseling Agencies that offer debt management plans. This recommended bond form is not mandatory. It does, however, include language the U.S. Trustee Program has determined to satisfy minimum requirements.
