ICE is proposing to enter into a contract for a Contract Detention Facility within the Detroit Area of Responsibility (AOR) to meet the AOR’s needs for detention space. The current ICE detention system consists of ICE-owned service processing centers (SPCs); inter-governmental service agreements with local, state, and U.S. Department of Justice facilities; and contract detention facilities.

The Department of Homeland Security (DHS) engages in immigration enforcement actions to prevent unlawful entry into the United States and to apprehend and repatriate aliens who have violated or failed to comply with U.S. immigration laws. Primary responsibility for the enforcement of immigration law within DHS rests with U.S. Customs and Border Protection (CBP), U.S. Immigration and Customs Enforcement (ICE), and U.S. Citizenship and Immigration Services (USCIS). CBP enforces immigration laws at and between the ports of entry, ICE is responsible for interior enforcement and for detention and removal operations, and USCIS adjudicates applications and petitions for immigration and naturalization benefits.

The Migrant Protection Protocols (MPP) are a U.S. Government (USG) action whereby citizens and nationals of countries other than Mexico arriving in the United States by land from Mexico -- whether or not at a point of entry -- may be returned to Mexico pursuant to Section 235(b)(2)(C) of the Immigration and Nationality Act (INA) while their U.S. removal proceedings are pending under Section 240 of the INA. MPP is a core component of the USG’s efforts to address the migration crisis along the U.S.-Mexico border.

On June 15, 2012, Secretary of Homeland Security Janet Napolitano established the policy known as Deferred Action for Childhood Arrivals (DACA) through a memorandum entitled “Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children.” Ever since, the policy has been subject to substantial controversy. In recent years, Acting Secretary of Homeland Security Elaine Duke and Secretary of Homeland Security Kirstjen Nielsen concluded that the DACA policy should be fully rescinded and issued additional memoranda in 2017 and 2018, respectively, to effect that decision.

These documents announce the decision of the Secretary of Homeland Security (Secretary) to continue to temporarily limit the travel of individuals from Canada and Mexico into the United States at land ports of entry along the United States-Canada and United States-Mexico border. Such travel will be limited to “essential travel,” as further defined in these documents.
