Information and Procedures for Processing American Recovery and Reinvestment Act Capital Fund Formula Grants

This guidance provides Public Housing Agencies (PHAs) and HUD Field Offices with information and procedures for processing the additional amount of Fiscal Year 2009 Public Housing Capital Fund Grants being provided in accordance with the American Recovery and Reinvestment Act of 2009 ("the Recovery Act"). This Notice applies to PHAs who received either a Capital Fund Formula and/or a Replacement Housing Factor (RHF) Fund Grant in Fiscal Year 2008 under the Capital Fund Program

The purpose of this Notice is to advise executive directors of PHAs that the Department is requiring them (or an authorized subordinate staff person) to certify to the accuracy of the data PHAs have submitted to HUD in the Inventory Management System/Public Housing Information Center (IMS/PIC) system that the Department will use to calculate the formula for allocating Capital Fund grants.

Public Housing Agency(PHA) Five-Year and Annual Plan Process for all PHAs

This Notice announces the availability of a revised PHA Five-Year and Annual Plan template (form HUD-50075), a PHA Certifications of Compliance with the PHA Plans and Related Regulations (form HUD-50077), a revised Annual Statement/Performance and Evaluation Report (form HUD-50075.1) and a revised Capital Fund Program-Five Year Action Plan (form HUD-50075.2). It clarifies the transition to new project numbers that took place in April of 2008 in accordance with PIH Notice 2007-28. Further, it implements Title VII of the Housing and Economic Recovery Act of 2008 (Pub.L. 110-289, H.R. 3221) which was passed by the United States Congress on July 26, 2008 and signed by President Bush on July 30, 2008.

The form is submitted as part of PHA Plan in accordance with part 903. The plan can be prepared based on a fixed or rolling five years.
Form HUD 50077 PHA Certifications of Compliance with the Plan Plans and Related Regulations This form is a composite of civil rights and other certifications that must be signed by PHAs and submitted to HUD in order to receive assistance.
