Section 184/184A Home Loan Guarantee Newly Published Resources

Dear Lender Letter 2020-12 - Extension of Re-verification of Employment and Tax Transcript Flexibilities and Updated Appraisal Flexibilities in Connection with the COVID-19 National Emergency The purpose of this Dear Lender Letter (DLL) is to inform lenders and servicers of an extension of the re-verification of employment and IRS tax transcript flexibilities originally issued in DLL 2020-05, extended in DLL 2020-06 and DLL 2020-08 and further extended in DLL 2020-10, for an additional period through December 31, 2020.  This DLL will also provide an updated scope of work inspection option providing for Exterior-Only Appraisals, which limits face to face contact for certain Section 184 and 184A transactions affected by the COVID-19 National Emergency. Dear Lender Letter 2020-11 - Section 184A Loan Limits This Dear Lender Letter (DLL) announces a technical correction by the Office of Native American Programs (ONAP) to the Section 184A loan limit for properties located in Hawaii County.  This DLL is effective immediately for all Section 184A loans that do not have a 184A cohort number assigned as of September 9, 2020. Dear Lender Letter 2020-10- Extension of Foreclosure Moratorium and Administrative Flexibilities Due to the ongoing COVID-19 National Emergency, HUD is extending the foreclosure and eviction moratorium applicable to the Section 184 Indian Home Loan Guarantee program and Section 184A Native Hawaiian Housing Loan Guarantee program through December 31, 2020. HUD is also extending the loan processing flexibilities originally issued in DLL 2020-05, and further extended in DLL 2020-08, through October 31, 2020. NEW! HUD’s Office of Community Planning and Development (CPD) Launches New Pilot Program to Help Individuals In Recovery From a Substance Use Disorder Become Stably Housed

On November 25th, CPD published a Federal Register Notice implementing a pilot program called the Recovery Housing Program (RHP).  This is a new $25 million grant program that was authorized under the Support for Patients and Communities (SUPPORT) Act.  The program allocates grant funding to various States to provide stable, transitional housing for individuals in recovery from a substance-use disorder. The funding covers a period of not more than two years or until the individual secures permanent housing, whichever is earlier. 

States that receive funding under this new program are authorized to provide assistance in a Tribal community, provided the Tribe consents.  States are also authorized to provide subgrants to Tribes and TDHEs to carry out this program.

REMINDER! Changes to Section 3

This Dear Tribal Leader letter highlights recent changes to Section 3 as a result of a Final Rule that was published on September 29, 2020.  Beginning on November 30, 2020, the effective date of the Final Rule, Section 3 will no longer apply to Tribes and Tribally Designated Housing Entities.

Federal Emergency Management Agency-  Notice of Funding Opportunities

• The Building Resilient Infrastructure and Communities (BRIC) program offers a $20 million set-aside for tribes to apply for funds to assist with pre-disaster mitigation projects, such as infrastructure, and mitigation capacity building.
• The Flood Mitigation Assistance Program is a competitive grant program that provides funding ($160 million available) to states, local communities, federally recognized tribes and territories that can be used for projects that reduce or eliminate the risk of repetitive flood damage to buildings (Tribes must be participants in the National Flood Insurance Program (NFIP) to be eligible to apply for this grant).

The application deadline for both grants is January 29, 2021.

CDC Issues a Nationwide Eviction Moratorium to Prevent the Spread of COVID-19

The Order applies to all tenants in the country who are subject to eviction for nonpayment of rent, including tenants assisted under programs administered by HUD’s Office of Native American Programs, such as the Indian Housing Block Grant program. This Order temporarily halts these evictions from September 4, 2020, through December 31, 2020. Please review this update in its entirety for more details on the applicability of the CDC's nationwide eviction moratorium. Please see the FAQs for more detailed information.

CARES Act Reporting Requirements- Training Material

On November 12, 2020, the Office of Native American Programs (ONAP) and the HUD CARES Act Compliance Response Team provided an overview of the reporting requirements under the CARES Act.  The training highlighted the Federal Funding Accountability and Transparency Act (FFATA) referenced in the CARES Act and provided an introduction on using the FFATA Sub-award Reporting System (FSRS) to comply with a portion of the CARES Act reporting requirements.

CARES Act Reporting Requirements 

This Dear Tribal Leader letter outlines reporting requirements under the CARES Act.  The Department is working to ensure that reporting systems will be available and in use before the January 10, 2021 reporting deadline.  In addition, ONAP will offer a  series of trainings to ensure that Tribes and Tribally Designated Housing Entities have the tools they need to report on the IHBG-CARES and ICDBG-CARES programs.

IHBG Competitive NOFA Implementation Schedule (HUD Form – 53247) 

A new Implementation Schedule (HUD-53247) has been added to the application package on grants.gov. The new form is fillable. Applicants may download the form and enter the necessary information directly to the form. The new file name is "New Implementation Schedule 53247IHBG"

Waiver of Undisbursed Funds Factor under IHBG Formula for FY21

Due to the impact of the COVID-19 National Emergency, Tribes and TDHEs have experienced delays in expending their Indian Housing Block Grant (IHBG) program funding.  To provide relief to these Tribes and TDHEs, HUD is waiving the Undisbursed Funds Factor at 24 CFR 1000.342 with respect to the fiscal year (FY) 2021 IHBG program allocation formula. The waiver provided in this Notice only affects the FY 2021 IHBG formula allocations and does not apply to IHBG formula allocations in years beyond FY 2021.

If you disagree with the Census data, you may wish to submit a Census challenge no later than March 30, 2021 for the FY 2022 IHBG allocation. If so, please review the guidelines in "Challenging U.S. Census Data: Guidelines for the Indian Housing Block Grant Formula." These guidelines can be found here:
