9.         Copyright Claims

The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that materials posted on this Page infringe your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. The notice must include the following information:

  1. a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. identification of the copyrighted work claimed to have been infringed (or if multiple copyrighted works located on the Page are covered by a single notification, a representative list of such works);
  3. identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow LSC to locate the material on the Page;
  4. the name, address, telephone number and email address (if available) of the complaining party;
  5. a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
  6. a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. If you believe in good faith that a notice of copyright infringement has been wrongly filed by LSC against you, the DMCA permits you to send LSC a counter-notice. Notices and counter-notices must meet the then-current statutory requirements imposed by the DMCA; see https://www.copyright.gov/ for details. Notices and counter-notices with respect to the Page should be sent to:
 Communications Manager
LSC Office of Government Relations and Public Affairs
Legal Services Corporation
3333 K Street NW
Washington, DC 20007

We suggest that you consult your legal advisor before filing a notice or counter-notice. Also, be aware that there can be penalties for false claims under the DMCA. Please note that the above name/address is for notifications of claimed copyright infringement only.

10.       Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the District of Columbia and of the United States of America without regard to conflict of laws provisions.  You and Legal Services Corporation agree that any legal or equitable claim or dispute relating to these Terms of Use shall be exclusively brought in the appropriate state or federal court in the District of Columbia and you agree to submit to personal jurisdiction in District of Columbia.

11.       Complete Agreement

These Terms of Use, together with our Privacy Policy, form the complete and exclusive agreement between you and Legal Services Corporation, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between you and Legal Services Corporation relating to the use of the Website. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not affect the interpretation of these Terms of Use. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
