Underage Purchase of Alcohol

In Alabama, the law enforcement exception to the prohibition against underage purchase of alcohol is contained in an administrative regulation, Ala. Admin. Code r. 20-X-13-.01. APIS was only able to research this Alabama regulation back to October 16, 1998. Based on the limited availability of historic administrative regulations, APIS cannot conclude this exception did not exist prior to this date in this or another regulation.

Although the amendment creating the law enforcement exception was approved in July of 2005, the effective date for the exception was made retroactive to September 27, 2004. See 2005 Alaska Sess. Laws 72.

Delaware does not have a statute that specifically prohibits purchase, but it does prohibit “obtaining” alcohol in connection with making a false statement. See Del. Code Ann. tit. 4, § 904(b). APIS does not include laws with such limitations in the Purchase policy topic.

Indiana does not have a statute that specifically prohibits purchase, but it does prohibit purchasing or attempting to purchase alcohol in connection with making a false statement or using false evidence of majority or identity. See Ind. Code § 7.1-5-7-1. APIS does not include laws with such limitations in the Purchase policy topic.

New York does not have a statute that specifically prohibits purchase, but it does prohibit purchasing or attempting to purchase alcohol by using false evidence of age. See N.Y. Alco. Bev. Cont. Law § 65-b. APIS does not include laws with such limitations in the Purchase policy topic.

Vermont previously had a law that made it a crime for a minor to "procure" alcoholic beverages. Beginning on July 1, 2000, however, Vermont only prohibits minors from procuring alcohol in connection with a false representation of age. See 2000 Vt. Acts & Resolves 160.
