Office of the General Counsel

Date: February 19, 1998
Matter of: [xxx]
File Number: s9700415

OPM Contact: Murray M. Meeker

On October 3, 1997, the Office of Personnel Management (OPM) received a claim for the restoration of forfeited annual leave from an employee at the U.S. Army Reserve Personnel Center (ARPERCEN) in [xxx]. However, by letter dated November 13, 1997, the Director of the Information Management Directorate at ARPERCEN informed OPM that the claimant had failed to obtain a Commander's decision. On January 16, 1998, OPM received a copy of a decision from ARPERCEN's Commanding Officer which denied the employee's restoration request.

By letter dated February 3, 1998, the employee advised OPM that she intended to pursue her claim as part of a discrimination complaint. OPM does not render decisions concerning allegations of employment discrimination in the Federal Government. OPM has, therefore, dismissed this claim.
