Appealing a Disability Claim

Decisions of disability claims can be appealed. A phone call to the Veterans Benefits Administration can find answers as to the reasons for a denial, the basis of the disability rating, and other pertinent questions regarding a disability claim. The Congressional office may monitor the progress of your appeal with the VA Benefits Office.

If all levels of appeal within the Regional Office are exhausted and still result in denial, a Notice of Appeal may be sent to the Court of Veterans Appeals. Notice of Appeal must be sent within 120 of the VA’s mailing of the notice of decision. This court is the highest level of review and outside of Congressional jurisdiction. Its decision in the matter is final.
