Sun Empire, LLC, et al. and Sun Group, et al.

On April 2, 2009, the SEC obtained a temporary injunction and asset freeze against Delilah Proctor and Shauntel McCoy, and two entities they controlled -- Sun Empire LLC and Empire Capital Asset Management -- in connection with a multi-level marketing scheme. According to the complaint, the defendants fraudulently raised more than $9 million from investors by promising them guaranteed returns on high-yield instruments with domestic and international banks, and other offshore entities. In fact, the SEC alleged that the defendants used investor funds for their own personal use and sent money to other entities under their control. The SEC also alleged that Proctor and McCoy diverted investor funds to three additional entities -- Sun Commerce and Investment, Infinity Investment Club LLC and Sunland Investment Club, LLC -- which the SEC named as relief defendants.

On May 18, 2009, the SEC amended its complaint to name additional defendants -- Bich Quyen Nguyen and Johnny E. Johnson, and their entities, Sun Group and Sun Investment Savings and Loan -- as participants in the alleged fraud. The SEC obtained a temporary injunction and asset freeze against them. The SEC also has named Recommended Services, Inc. and Tycoon Club International as relief defendants.

The Court appointed Richard Weissman as Receiver over the four entity defendants. On August 17, 2011, the Court entered an order approving a claims administration procedure in connection with the Sun Empire case. To recover funds from the Receivership entities, investors need to complete the attached Proof of Claim form and submit it to the Receiver no later than October 31, 2011.
