This policy memorandum provides further guidance on the Special Supplemental Nutrition Program for Women, Infants and Children programmatic waivers as authorized under the Continuing Appropriations Act, 2021 and Other Extensions Act (PL 116-159), in response to the COVID-19 public health emergency.

FNS is allowing FMNP state agencies to conduct initial training remotely. 

This notice invites the general public and other public agencies to comment on this proposed information collection. This collection is an Extension of a Currently Approved Collection.

The Families First Coronavirus Response Act provides WIC Farmers’ Market Nutrition Program state agencies, including participating Indian Tribal Organizations and U.S. Territories, the opportunity to request a waiver of WIC regulatory requirements.

The proposed information collection is a request for a revision of a currently approved collection of information relating to the reporting burden associated with completing and submitting form FNS-339, the Federal-State Supplemental Nutrition Programs Agreement for the administration of the Special Supplemental Nutrition Program for Women, Infants and Children (WIC); the WIC Farmers' Market Nutrition Program (FMNP); and/or the Seniors Farmers' Market Nutrition Program (SFMNP).

In accordance with the Paperwork Reduction Act of 1995, this notice invites the general public and other public agencies to comment on this proposed information collection. This collection is a revision of a currently approved information collection for the WIC Farmers' Market Nutrition Program (FMNP) Regulations for the reporting and recordkeeping burden associated with the WIC FMNP Program regulations.

This policy memorandum transmits changes from the Office of the Assistant Secretary for Civil Rights regarding the appropriate nondiscrimination statement to use on Farmers’ Market Nutrition Program (FMNP) materials.  This policy memorandum supersedes, Civil Rights Memorandum, USDA Nondiscrimination Statement Update, dated May 24, 2013, and the last issued FMNP Policy Memorandum 2010-1 dated April 15, 2010. This memo also includes the Spanish version of the NDS recently released.

This interim final rule amends the WIC Farmers’ Market Nutrition Program (FMNP) regulations to codify three FMNP nondiscretionary provisions mandated in the Child Nutrition and WIC Reauthorization Act of 2004.

The purpose of this policy memorandum is to advise you of a legislative change that affects the WIC FMNP regulations concerning the maximum penalty for misuse or illegal use of FMNP funds, assets or property.

This policy memorandum authorized the implementation of the nondiscretionary WIC FMNP provisions as contained in PL 108-265.
