My musical influences are: My parents and violin teacher, who exposed me to composers like Beethoven, Kreisler, Mozart and Paganini—incredible musicians who defied the styles of their day. Also, the people I’ve shared the stage and studio with—all who came from different musical backgrounds, which helped expand my collaborative and creative abilities.

I realized I was ready to #TakeTheLeap when: I was in the final stages of creating my debut album—I had played guitar, violin, ukelele, keyboard, percussion, and synths on it, and the people I would share it with really dug it.

1) Promotion Period

The AXE White Label Collective (the “Promotion”) begins at 12:01 p.m. Eastern Time (“ET”) on May 4, 2015 and ends at 11:59 p.m. ET on May 24, 2015 (the “Promotion Period”).

2) How To Participate

During the Promotion Period, you can participate by visiting https://secure.axewhitelabel.com/collective (the “Page”) and completing all required registration information including a video (between 30-60 seconds long), and up to three photos and optional caption that showcase one or more of your original menswear fashion pieces including, but not limited to clothing, outerwear and accessories (collectively, the “Submission”). The Submission should highlight how and why you became a designer, what inspires your designs and how you define your personal style. Submission must include a video or photo showing your design in production; a design sketch is not eligible. Design must be depicted in the video or the photo. Photo submission is not required. If applicable, you must make all those depicted in the video/photo aware that you are entering a video/photo on their behalf and attest that all depicted (or the parent or legal guardian of any minors depicted) have agreed that you may submit such video/photo. The person submitting the video/photo will be considered the Participant (the “Participant”). Only the Participant will be considered for an opportunity, as described below, regardless if others are depicted in the Submission. There is a limit of three (3) unique Submissions per Participant for the Promotion Period. If Participant has any retail distribution of their designs, the distribution must be limited to three (3) locations (not mass retailers/chains, in Sponsor’s sole discretion). Participants with retail distribution in more than three (3) locations will be disqualified. By participating, you understand and agree that your Submission may (in Sponsor’s sole discretion) be posted online for consumers to view on the Page or other Sponsor-selected sites. Sponsor will only be posting select Submissions (in their sole discretion). Sponsor reserves the right to remove any posted Submissions, in its sole discretion, even if the Submission has already been made available to the public. All Submissions must be completed and submitted by 11:59 p.m. ET on May 24, 2015. Normal Internet access and usage charges imposed by Participants’ online service may apply.

3) Submission Requirements

By participating, you understand your Submission may be featured on the Page or other Sponsor-selected Sites and you agree to waive any rights you may have to the Submission. In order to participate in the Promotion, Participants must comply with registration instructions when submitting their Submission. The video must be submitted as a .mov or .mp4 format and must be 60 seconds or less. If submitting a photo, the photo must be submitted as a .png, .jpg, .jpeg, or .gif format and no larger than 10MB. All Submissions must be owned solely by the Participant and must be the Participant’s sole, original work. The Entry may not contain obscene, profane, lewd, defamatory or inappropriate images or text including no nudity, acts of violence or acts that appear to cause harm or are illegal/dangerous, as determined at Sponsor’s sole discretion. Any Submission or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, highlights brand in a negative way, contains any third party materials (other than an AXE logo), or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, may not be considered and may disqualify the Participant. Therefore, clothing worn or props/items used in the video/photo should not contain any visible logos (other than an AXE logo), drawings, cartoons, phrases, trademarks or other third-party materials. Participants may not copy or otherwise plagiarize the Submission from any source. Sponsor has the sole discretion to determine whether a Submission qualifies for the Promotion. Sponsor may blur or black out the infringing material, in their sole discretion, for consideration to be featured. By submitting a video/photo or being depicted, you (or parent/legal guardian) hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Submission or excerpts of Submissions (as such may be edited and modified by the Sponsor at its discretion) for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, Social Media sites and/or other Sponsor-selected media. In addition, you (or parent/legal guardian) hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Submission. You (or parent/legal guardian) further agree to waive any moral rights in and to the Submission. Automated, script, macro or robotic videos submitted by individuals or organizations will be disqualified. If, at Sponsor’s sole discretion, the Submission appears to have resulted in any injury or bodily harm, it will be rejected. Submissions must be in keeping with Sponsor's image and may not be offensive, as determined by Sponsor at its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. In such an event, the Submission may not be considered for the Promotion. Any Submission not in compliance with the above and does not meet the Submission website’s requirements, may not be considered.

4) Eligibility

Open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of date of Submission. Employees of Conopco, Inc., d/b/a Unilever (“Sponsor”), Esquire, their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively “Sponsor and its Administrators”), and each of their respective employees, shareholders, directors, officers, members and agents and their immediate family members spouses, parents, children, and siblings and their spouses) and/or those living in the same household of each are not eligible to participate. Participants must not have retail distribution of his/her fashion designs at more than three retail locations (those locations may not be national or regional mass distribution/chain retailers, in Sponsor’s sole discretion). All federal, state and local taxes are the sole responsibility of Participant (or the parent/guardian if Participant is a minor in his/her state of residence). Void where prohibited by law and subject to all federal, state and local laws.

5) Participation Determination

All Submissions will be judged on or about May 27, 2015, by Sponsor-select judges based on the following criteria: Originality/Creativity (40%), Fashion Innovation (40%), Overall Appeal and Confidence (20%), to determine five (5) Top Participants to receive tools and mentorship to hone their talent and the opportunity to showcase their work through Sponsor selected media outlets and physical event spaces as described below, and ten (10) additional Participants will be determined to receive an opportunity to be featured in Sponsor selected media outlets. Any tied Submissions will be rejudged by the judges based 100% on Fashion Innovation.

6) Opportunities and Approximate Retail Values ("ARVs")

Top Participants Opportunity (5 total): A chance to showcase their menswear design at a Sponsor-selected event on September 10-11, 2015, and have their talent featured through Sponsor-selected media channels (including participation in a photo shoot June 8-10, 2015 to be featured in the September issue of Esquire magazine, in Sponsor’s sole discretion) and a Sponsor-selected prize pack including AXE White Label products and a $2,000 check made payable to the winner to be used to complete their menswear design. Includes round trip coach air transportation and hotel for Top Participant only on Sponsor-selected dates for a showcase at a Sponsor-selected event, photo shoot, and possibly, a Sponsor-selected 45 minute long in-person mentor session with Sponsor-selected top menswear designer (may be awarded as a Skype session, in Sponsor’s sole discretion) (Max. ARV $10,000 each). Actual ARV of Top Participant Opportunity may vary due to Participant’s residence, dates of travel and fares at time of travel. All components are subject to availability and all details of the Opportunity are Sponsor-specified and at Sponsor’s sole discretion. Additional Participants Opportunity (10 total): The opportunity to have Participant’s talent featured through Sponsor-selected media channels. There is no retail value associated with the feature(s) on Sponsor-selected media channels. Sponsor will determine all details of the feature(s), including duration, exposure and exact channels. Opportunity is awarded “as is” with no warranty or guarantee, either express or implied. Opportunities cannot be redeemed for cash. No substitution or transfer of Opportunity permitted except at the sole discretion of the Sponsor who reserves the right to substitute the Opportunity (or portions thereof) with an Opportunity of comparable or greater value in the event the Opportunity (or portions of the Opportunity) is unavailable. Opportunity and all components may be substituted for any reason at the discretion of the Sponsor. All federal, state and local taxes are the sole responsibility of Top Participants (or the parent/guardian if Top Participant is a minor in his/her state of residence), if applicable.

7) Top Participant Opportunity Rules

Portions of the Opportunity may be awarded as a gift card, gift certificate or voucher, in Sponsor’s sole discretion. Tickets, gift cards and vouchers are subject to terms and conditions specified by issuer. Airline carrier's regulations and conditions apply. Travel may not be combined with any other offer and travel may not qualify for frequent flyer miles. Top Participant, as applicable must possess valid travel documents (i.e., valid government issued photo ID) in order to travel. Seat selection and timing of travel subject to availability and confirmation of reservations. Certain restrictions may apply including black-out dates. Travel must be taken on dates specified by Sponsor in June and September 2015 or Opportunity will be forfeited and Sponsor will have no further obligation to Participant. Travel must be round trip. In the event the Top Participant lives within a 150-mile radius of destination city, round-trip ground transportation will be provided in lieu of air transportation and no additional compensation will be provided for air transportation portion of the Opportunity. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. No refunds or credit for changes are allowed. All expenses and costs, associated with Opportunity acceptance and use not expressly listed above as being provided, including, but not limited to, taxes, tips, meals, ground transportation, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges, personal charges at lodging, security fees, entertainment and transfers, are Top Participant's sole responsibility. In the event the mentor session and/or fashion showcase are cancelled for reasons outside of the Sponsor’s control, that portion of the Opportunity will not be awarded and no additional compensation will be provided; however, remainder of Opportunity package will be awarded and Sponsor will have no further obligation to Participant. In the event the Top Participant cannot accept any aspect of the Opportunity, the Top Participant will forfeit the Opportunity and an alternate Top Participant will be determined, time permitting.

8) General Rules

The Administrator will make three (3) attempts to contact the potential Top Participants via phone/email within 24 hours from the time of determination. If Administrator is unable to reach the potential Top Participants via phone/email within this time frame, he/she will be disqualified and an alternate Top Participant may be determined, time permitting. Potential Top Participants (or parent/legal guardian if Top Participant is a minor in her state of residence) will then be required to sign and return via overnight mail or email, an Affidavit of Eligibility, liability/publicity release (except where prohibited by law) within 48 hours (including weekends) of notification attempt or the prize will be forfeited and alternate Top Participant may be determined, time permitting. If anyone other than the Top Participant is depicted in the Submission, additional releases may be required. Affidavit will be sent to the potential Top Participant via Priority Mail or sent via email. Additional Participants may be notified via email within 2-3 weeks after the conclusion of the Promotion. Return of notification as undeliverable may result in disqualification and alternate determination. Sponsor reserves the right to conduct a background check on the Top Participants and reserves the right in its sole discretion to disqualify any Participant based on the results of such background check, if Sponsor determines in its sole discretion that awarding the Opportunity to such Participant might reflect negatively on Sponsor. Factors that would result in disqualification of a Participant include, without limitation, any Participant having been convicted of a felony or misdemeanor, being delinquent on a government ordered payment, such as child support, spousal support, alimony, tax payments, etc. Participants and those depicted in Submissions, if applicable, as a condition of participating in the Promotion, agree to release Sponsor and its Administrators, Esquire, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Promotion (collectively the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with creation of or submitting a video or otherwise participating in any aspect of the Promotion, the receipt, ownership or use of any Opportunity awarded or any typographical or other error in these Terms and Conditions or the announcement or offering of the Opportunities. Acceptance of an Opportunity constitutes permission to use Participant’s names, likenesses and Submissions for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By participating in the Promotion, Participants agree to be bound by the Terms and Conditions, and the decisions of the judges, which shall be final and binding in all respects. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Promotion or by any human error which may occur in the processing of the Submissions in the Promotion or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Promotion. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the Submission process or the operation of the Promotion; violates the Terms and Conditions; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a Participant, the authorized account holder of the email address used to participate will be deemed to be the Participant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then the Sponsor reserves the right at its sole discretion to cancel the Promotion and award any of the Opportunities from among all eligible Submissions received prior to cancellation, based on the same criteria listed above. You hereby represent and warrant that you have read these Terms and Conditions and are fully familiar with its contents. As a condition of participating the Promotion, Participant (or parent/legal guardian if Participant is a minor in his/her state of residence) agrees that: 1) under no circumstance will Participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Promotion, or any Opportunity awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees.
