January 26, 2013 | By Federal/State Partnership Staff

Contact Kathleen Mitchell at 202.606.8302 or by email at kmitchell@neh.gov to request electronic copies of the insurance policies.

Federal/State Partnership provides each of the 56 state humanities councils three basic insurance policies as protection of the National Endowment for the Humanities' investment in the councils. The policies are renewed annually on April 1. The 2012-2013 policies are available now.

The 2012-2013 policies include endorsements covering employee dishonesty and terrorism. Federal/State Partnership does not provide directors and officers liability coverage, but strongly recommends that each council carry it. Each council should review these policies with its insurance broker to ensure that there is not duplication of coverage.

The broker is McManus Serra & Klein Insurance Brokers, Inc., 400 Greenwood Avenue, Wyncote, PA 19095, 215.481.0400 phone, 215 481-0410 fax. Our contact person is Frank Serra. Please feel free to call him with any questions. The Federal/State Partnership contact for insurance is Kathleen Mitchell.

The policies provided by Federal/State Partnership are, in summary:

1. Package
General Liability with an occurrence limit of $1,000,000. General Liability protects a council against suits brought by people external to it (i.e., not staff or board of a council) for bodily injury or property damage (slip and fall injuries) suffered by them while on or off a council’s premises.
Property: Office Contents with a $250,000 limit. The office contents coverage includes everything inside the walls of its offices. The walls, floors, ceilings of the office are not covered, nor are any buildings.

Employee Dishonesty with a $10,000 limit. The current policy contains a deductible of $1,000.

2. Auto Liability

Non-Owned Auto Liability with an occurrence limit of $1,000,000. There is coverage for the Council when autos, vans, and trucks NOT owned, leased, or rented by a Council, are the cause of a lawsuit, by external parties, against the Council. This policy protects the Council and does NOT extend to any directors, officers, employees, or volunteers as individual drivers or to their vehicles.

Hired Car Auto Liability with an occurrence limit of $1,000,000. The current policy also provides additional (excess) protection to a council for suits brought against it when it has failed to purchase sufficient liability coverage for its rented vehicle.
In NO circumstance does the policy provide for physical damage to that rented vehicle.
3. Umbrella Policy with a $5,000,000 limit. This policy enhances the coverage limits of the other policies.

A few of the major items that are NOT COVERED by these policies include:

  Building coverage
Business interruption
Flood
Products/Completed operations
Employee benefits liability
Automobile liability coverage for owned, leased, or rented vehicles
Automobile physical damage for any vehicle
Workers compensation
