The National Prevailing Wage Center (NPWC) is currently processing the dates posted on iCERT above which reflect the month and year in which applications were filed (request date) or submission date of the appeal request for Redeterminations or Center Director Review. The NPWC is unable to give priority processing or expedite prevailing wage determinations as requests are processed in the order in which they are received. However, each prevailing wage request is unique, and processing times may vary depending on material facts and individual circumstances of the request. NPWC gives each prevailing wage request its careful attention and processes each request as efficiently as possible. The Department encourages employers to continue to request a prevailing wage determination (PWD) for the H-2B program at least 60 days before the date the determination is needed. Requestors may check case statuses via the iCERT portal at https://icert.doleta.gov/ or contact our Helpdesk for a status on the application at flc.pwd@dol.gov.

The actual processing time for each employer’s prevailing wage application may vary from the average depending on material facts and individual circumstances of the request. OFLC is only reporting the average processing time for all prevailing wage applications for the most recent month.

PERM Processing Times (as of 1/12/2017)

The Analyst Review and Audit dates posted on iCERT above reflect the month and year in which cases were filed that are now being adjudicated at the Atlanta National Processing Center. *The Reconsideration Request to the CO dates posted on iCERT above reflect the month and year in which cases that are now being reviewed at the Atlanta National Processing Center were appealed. For various reasons, we may be completing the processing of applications filed prior to the month posted on iCERT. If your application was filed more than 3 months prior to the month posted, you may contact our Helpdesk for a status on the application at plc.atlanta@dol.gov.

H-2A Processing Times (updated as of close of business 01/20/2017)

These tables are intended to help employers understand the processing of H-2A applications on a weekly basis. The tables indicate the calendar week from which employer applications initially received at the Chicago National Processing Center (CNPC) are under active review and issued either a Notice of Acceptance (NOA) or a Notice of Deficiency (NOD), as well as the percentage of all cases received during that calendar week that have been issued an initial or 1st action. As soon as all 1st actions for applications received during the calendar week are issued (i.e., 100% complete), the CNPC will move to the next calendar week of applications received and the chart will be updated accordingly.

*A “complete” H-2A application is defined as one containing all the documentation required by law or regulation (e.g., recruitment report, farm labor contractor license, housing inspection report) necessary for the OFLC to issue a final decision 30 days before the employer’s start date of work. For “incomplete” applications, OFLC must either issue Notice of Denial or provide employers with additional time to submit documents necessary to meet program requirements. Providing additional time could extend the processing time of any individual application beyond 30 days, thereby increasing average processing times. The actual processing time for each particular H-2A application may vary from the average depending on material facts and individual circumstances of the case. OFLC is only reporting the average processing time for H-2A applications for which processing was completed over the most recent two-week period.

H-2B Processing Times (updated as of close of business 01/23/2017)

These tables are intended to help employers understand the processing of H-2B applications on a weekly basis. The tables indicate the calendar week from which employer applications initially received at the CNPC are under active review and issued either a Notice of Acceptance (NOA) or a Notice of Deficiency (NOD), as well as the percentage of all cases received during that week that have been issued an initial or 1st action. As soon as all 1st actions for applications received during any particular calendar week are issued (i.e., 100% complete), the CNPC will move to the next calendar week of applications received and the chart will be updated accordingly.

This table displays the average number of calendar days it takes the CNPC to process cases and issue a NOA with no deficiencies, as measured from the case receipt date to the date a final determination is issued. Although each employer application and recruitment effort is unique, we believe that displaying a cumulative average based on the last two weeks of all cases processed to a final determination will provide employers with information that can help them plan for their workforce needs in relation to the expected start date of work. The actual processing time for each particular H-2B application may vary from the average depending on material facts and individual circumstances of the case. OFLC is only reporting the average processing time for H-2B applications for which processing was completed over the most recent two-week period.
