Got a call yesterday evening while driving down the road, went into a hole lost contact tried to call back, was told I was not eligible for benefits and still can’t figure out how they come up with that prognosis would like to get a call back. I have COPD and both knees replaced!
You need to speak to a lawyer specializing in SSD cases. Most provide free consultations. It is often difficult to get to speak to someone at SSA. I have done this work for over 30 years and would be happy to provide a free initial consultation. But you can also call NOSSCR which has the names of attorneys throughout the US who do this work. We recommend that you call our toll free number at 1-800-772-1213 and request information on the status of your claim. As I read all this about getting disability payments I’m digusted at how,in the budget deal of 2015,money was ripped off from what was file and suspend to continue to fund a broke system where fraud is rampant. As an LA Times article said elderly divorced women would be the victims of this injustice.
It’s a hard process to navigate. My sister is mentally ill and has been denied based on the idea that she could physically do manual labor. Problem is that mentally she can’t hold a job. She’s been terminated twice in the last six months. She’s been denied disability and we had to petition for a hearing. It takes 18 months to get a hearing. So in the meantime I have to support her emotionally and financially.

I had to wait for 1 1/2 Year’s with no Income before I got mine and I had a Lawyer they take Quite a chunck off the top if they win your case for you and I only recieve $1,000 a month with house payment and all utitities and Insurance’s forget getting any grocery’s I can starve and they don’t care

SSDI is a necesarry lifeline for so many americans today. I know that, if given the choice, many many of us would love to be able to work, go back to work. Still, we are all so very grateful that SSDI exists, for if it did not, many of us would not. This is my reality. I earned my SSDI for 32 years and was no where near ready to stop working, when my disabilitiea said “you can’t work right now. You have limitations”. Well, although this is true today, I have not given up on the hope that I may and can go back to work, one day. There are still goals and dreams that I want to achieve. My continuing college education is one big dream and goal. I need to work, in order to afford continuing. I really hope I can work again, one day. At least I have much needed support, through My SSDI, today. Without it, I would have nothing. Thank You SSA!

My husband has been denied 2 times, he has a plethora of issues, one being narcolepsy. For the last determination, SSD didn’t review all of the medical records. They had 3 additional months of medical records never taken into consideration with dr diagnosis, and now, there are even more issues!
He was terminated from his propane delivery tank driver last year. I am out of work and we have no income, no unemployment and 2 kids. IRA/401k exhausted, and now it’s becoming a crisis to pay the mortgage. We can’t wait any longer or we will lose everything. I was at my job for 18 years, and since 2013 had a couple of contract jobs but hopefully something will come up soon.
In the meantime, are there programs to fast track this? We have been extremely diligent with medical records and submitting info on time, it’s disappointing the determination was not based on everything we submit.

Ignore Sanchez, he’s a loose cannon. Evidently you do not meet the definition of meeting the “insured status” under the law. Any SS representative can explain that to you for free. Going to a third party will not change your work history in any way. SS representatives also make referrals to other agencies.

I agree completely. Please stop giving advice when you obviously have a limited knowledge of how SSDI works.
The system is a pile of garbage with red tape so they can say no to everybody except for friends and relatives and so that lawyers can earn their keep. My uncle 25 years ago had a quadruple bypass and needed a lawyer to have disability approved. I know know someone with a terribly severe autoimmune disease and was denied disability and had to hire a lawyer to be approved. Practically everybody working in the disability department needs to be fired, especially the person running it.
SSDI has very clear guidelines of what constitutes disability and many people do not understand this, but can have it better explained through a legal representative who MIGHT then be able to help them get the correct medical evaluations and documents for their claim, if it is a valid claim. It has nothing to do with friends or relatives and lawyers help people get on and to understand the process. Ranting does not help anyone. Denials and a long time frame are part of this process. It is unfortunate, but that does not make it a scam. It took me a year and a half to get approved and yes, I did turn to a lawyer and I also turned to educating myself so I could help my lawyer and also the SSDI decision makers rule in my favor. If you truly are disabled and eligible for benefits, you can allow the system to get you where you need to be and it will work.
That is true, I apply in the Internet on Oct >Nov. 2012 and was seduced to see local office on Dec 2012. After interview I was approved for compassionate allowances that I did not know was existed and recieved it for full six months. Then July was stop making payment. Same month of July the SSA approved the SSDI the 180 days after you received the first check of benifits. But without telling if you are qualified for 5 months retroactive. All their explanation is 5 months waiting period as being legitimate disabled. Hmp, December 2012 when you applied for SSDI but only approved that you are disabled on July 15 2013And No payment for 5 months as waiting period..from Aug to December 2013 First benifit monthly check after the thirty days of January 2014… no retroactive….look like unfair that there is no back payment from July to December 2013.
I was injured at work 12 years ago. I applied for SSDI & was denied. Thankfully Workers Comp helps out. Since my injury I was divorced after 30 years of marriage. Which besides not getting any alimony or a penny from my ex, he’s on SSDI just prior to the divorce. My question is I’m afraid of losing my home. They decreased my Workers Comp rate after the divorce! Crazy! I have documents for every specialist they’ve sent me to all of which state I am totally, permanently disabled. Now, if I apply again what happens with the money I collect from Workers Comp? I don’t want to end up with a lesser amount of money. I can’t afford food most weeks. I’m getting older and now it all scares me. Any advice what or how this works?

I receive SSDI. Will the amount I get ever change? Besides the cost of living amounts.
Thank you for your question Tes. Disability payments are established at the highest rate possible, and we used the highest years of your earnings to calculate your monthly benefit amount. We base it on your average lifetime earnings before your disability began. When you reach your full retirement age, we will automatically convert your disability benefits to retirement benefits, but the amount remains the same.

The DDS usually determines if someone meet the Listing for a mental disorder. The ALJ hardly ever says a person meet the Listing for a mental disorder.
This is the concept of the hearing. If the claimant meet the Listing for the mental disorder, then why does the ALJ request a Vocational Expert(VE) at the hearing. The ALJ is wasting taxpayer’s money. The VE is used at Step 5 when the Listing is not meet.
At Step 5, before making a determination that includes vocational evaluation, the ALJ should discuss the case with a psychiatrist or psychologist.

The ALJ shouldn’t even consider a VE without discussing it with the psychiatrist or psychologist. If the ALJ doesn’t discuss the case with a psychiatrist or psychologist, then there is no need for a VE and the claimant should be denied.

The DDS has already denied the claimant once or twice before the hearing. If there is something overlooked or underrated, then the ALJ should discuss the case with a psychiatrist or psychologist.
Hello I’m receiving ssdi benefits I’ve been on for around 11 years at first I had my spouse and 3 children receiving benefits from my ssdi since then they have taken my son age 25 off he is also disabled and has been denied his own ssdi benefits.now my oldest daughter is 22 years old she was taken off when she turned 18 same situation she applied and was denied now my youngest when she turned 16 they took my spouse off from receiving and benefits she is also disabled but doesn’t have enough work credits to receive any benefits she has been trying sing we got married 26 years ago she has a multitude of disability problems.I have helped her with protesting the decision made and as usual denied

Too bad I can’t work for the Cooperative Disability Investigation unit with my mental disorder. I could catch a whole bunch of fraudsters saving Social Security millions.
There use to be a Section in the POMS about how to flag fraud claim. When the SSA develop the CDI unit, they erase that section. The SSA can’t catch the smart fraudsters. The can only catch the dumb ones. There are not many dumb fraudsters. Fraudsters do a lot of research not to get caught. You need a smart fraudster to catch a smart fraudster.
The fraudsters already know the SSA is only going after people who have worked and got a 1099 tax form or filled out a W-4 tax form. The lazy fraudsters don’t work at all and never will be caught.
The best chance of stopping the fraudsters is before they are approved.
Mental illness is the easiest way for the fraudsters to collect free Social Security disability money. I gave a whole bunch of information on how to prevent and catch fraud cases.

I filed for disability a few months after I had to leave my long time healthcareer of 39 years. I have been waiting for 2 1/2 years for approval. Filed twice appealed twice. I have a disability atty helping me now. I am waiting for a hearing now. I have been notified that a hearing is coming.
I have had a severe mood disorder my entire life controlled with meds. I had four serious hospitalizations throughout my lifetime for the mood disorder.
I try to go back to work, apply for work then get overly anxious about returning. I am stuck.

Most of this site’s answers tries to baffle you with OBAMA ADMINISTRATION smoke filled excuses and rhetoric. They won’t tell you why the COLA is practically non-existent but your outlay for health and living expenses keep going up. Also they are raising your medicare co-pay and deductible but you won’t here about this. So even if you get any COLA you losing money from your total SS benefit.
My cousin has brain lesions which have caused cognitive issues along with severe vision loss so she is disabled. She was married when all of this came about and her husband could not deal so he divorced her and gave her a small settlement. She did not have an extensive work history because of her children and only taught at a university for a short while before the first attack. Her husband owned his own business but refused to help provide for her. She draws a very small check less than 700.00 a month. I assume from her own SS. Is she eligible to draw from her ex-husbands benefits . she is now 54

HOW ABOUT IF YOU ARE TOTALLY DISABLED AND NO ONE HIRES YOU BECAUSE YOU ARE DISABLED, HOW CAN YOU BUILD UP “CREDITS” OR “POINTS” UNDER THAT KANGAROO COURT SYSTEM?
I am 45 years old, a mother of three older children and physically disabled ( I was born with cerebral palsy ). I’ve never collected one red cent of money from the Socialist Security System, even though I have applied several times and they find me disabled.
Technically, I am an “adult disabled child” (please look this up, it is NOT SSI or SSDI) but have never been able to secure any benefits whatsoever from the Socialist Security system, even under that program because I got married to an “Able bodied person”. The Socialist Security system is too busy paying benefits to some people who scam the system and worrying about adult disabled children (who they pay benefits to off of a parents record) marrying an able bodied person. This gives them the justification to cut off benefits to the adult disabled child because the husband (in theory) can now support the disabled person. This theory works great, if your husband is rich and you have no need for money but what it actually does, is to force two adults (one disabled one able bodied person) to live off of one income. In the real world, the socialist security system is forcing adult disabled children to only marry other disabled persons (and NO able bodied persons) at the threat of loosing any and all benefits that they are entitled to.
If you are a physically disabled person (an adult disabled child) and you happen to marry an “able bodied person” you will be loosing out on a lifetime of benefits, all because of a one word “rule” that prohibits you from marrying an “able bodied person”. Best of all, they never tell you about their “Rule” so that they can justify cutting off any benefits that you may be due.
Because you are physically disabled (adult disabled child) and you choose not to marry another adult disabled child or disabled person drawing off socialist security, you WILL LOOSE ANY AND ALL BENEFITS FOR LIFE. This means that the SOCIALIST SECURITY system is TELLING YOU WHO YOU ARE ALLOWED TO MARRY and who you are
NOT ALLOWED TO MARRY! It is a discriminatory act “rule” and should be ILLEGAL!
Even though I am permanently and totally disabled, if I marry an “able bodied person”, somehow that marriage makes everything ok and I am no longer considered disabled (in the eyes of the socialist security system). Magically (because I married an able bodied person), the pixie fairies come down and cure my disability, because now I can just go out and find gainful employment, no one will discriminate against my physical disability and everything will be grand, right? Somehow magically, marrying an able bodied person makes my physical disablility dissappear and now I am cured, right? WRONG!
The issue is a special “Rule” that the Socialist Security System uses to discriminate against “certain” people. If you are a “physically disabled person” (AKA-certain people) and happen to marry an able bodied person, then the SOCIALIST SECURITY system will use special “Rules” to legally discriminate against you and deny you benefits, even if you appeal online.
The SOCIALIST SECURITY system has caused me a lot of economic hardship all because I married an able bodied person. The SOCIALIST SECURITY system thinks someone who is physically disabled (permanently and totally disabled) marries an “able bodied person”, that somehow magically they are cured of their physical disability and two people can survive off the able bodied persons income. WOW, talk about a bunch of bureaucratic idiotic thinking, that somehow this would not cause a financial hardship….. amazing.
The rules that the Social Security Administration uses to legally discriminate against persons who are “Adult Disabled Children” who happen to marry an able bodied person, are discriminatory. This is loosely referred to as the “marriage penalty” but I call it exactly what it is, a legal form of discrimination.
I firmly believe this rule, is an act of bias, prejudice and discrimination against people who (by no fault of their own) are born disabled and happen to marry an able bodied person
Please write your Congressional Representative and tell them to end this modern day form of Legal Discrimination. In this day of fairness and equality, there are still some people suffering from an outdated and oppressive bureaucratic rule.
(PS. notice how the only thing any of these SOCIALIST SECURITY workers ever say are quotes of the rules or processes, like a worker drone. They are unable to address any topics that fall outside of their rule books). Typical bureaucracy and bureaucratic responses, like trying to argue over lost change with a vending machine!

A widow or widower can begin receiving benefits as early as age 50 if, he or she is disabled (under our rules) AND the disability started before or within seven years of the worker’s death. II was approved without an attorney in about 6 weeks I was so bad. Problem, you still get discriminated against. In NH Superior Court where I have an ADA case. The New Hampshire Commission for Civil Rights found probable cause and the Elks appealed to Superior Court. I’m a member of the Elks. I asked for a meeting time change of the Home Committee to the day or weekend to talk about illegal activity in the Lodge as an accommodation to my disability as at night I am too fatigued. They refused. The Amendments Act of the ADA from 1989 says extensive analysis shall not be required to determine a disability. It also states your are considered disabled if you have a previous disability. The Judge allowed the Elks attorney to depose 7 of my doctors, requested all the medical information from my doctors for over 10 years, all my financial information and for me to answer all medcial questions which they were going to get from the doctors anyway just to harass me. The Regional ADA opined that was way to much information according to what Congress wanted. The Judge in NH ignored it and allowed all the information. No “supposed” disability organization has helped. They all have no time. The NHCHR is a joke and the Governor’s Commissionis worse when it comes to help. Congressmen Guinta got no where. So you may be disabled but don’t file any ADA cases. There is no help.

A 59 years old disabled man apply for SSDI dec. 2012 . Compassionate Allowances SSI was given and start on Jan to the end of June 2013, SSA found the man was disabled on July 15 ,2013, No SSI or SSDI received from July to Dec. 2013, Benifits begin on February 2014. The Question here, Is there any Retroactive payment from July 15 ,2013 to the end of December 2013.

Current law requires everybody that is approved for disability benefits under the Social Security Disability Insurance or SSDI program to serve a 5 month waiting period. The first Social Security disability benefit payment is paid for the sixth full month after the date the disability begins. Here is an example: If the state agency decides your disability began on January 15, your first disability benefit will be paid for the month of July. Social Security benefits are paid in the month following the month for which they are due, so you’ll receive your July benefit in August.
You mentioned SSI payments for 6 months. The Supplemental Security Income or SSI program is a needs based program that pays benefits to disabled adults who have limited income and resources. A provision within the SSI program allows local Social Security offices to make “presumptive” disability payments to individuals that apply for SSI for the first time, and meet all the non-medical factors of eligibility, and their medical condition is such that there is a strong likelihood that their claim will be medically approved. These payments may be made for up to six months while waiting for the formal disability decision. We hope this information helps!
Thanks for the earliest reply. My State as I mentioned they are all good to handle this situation without any help of any lawyer. My question is the waiting period of five months for a legitimate DIS abled. I understand the procedure the first monthly check is after full six calendar month. But what happened to the first five months of being legitimate disabled ? Any Back payment of the said first five months ?
Hi Edwin.The waiting period consists of five (5) full calendar months in a row and you are not entitled to benefits for any month in the waiting period. The 5 month waiting period ensures that during the early months of disability, we do not pay benefits to persons who do not have long-term disabilities, and avoid duplicating other income protection plans (such as employer sick-pay plans) during the early months of disability. Remember that Social Security disability benefits are paid to individuals who cannot work because of a disability that is expected to last at least one year or result in death.
Also there is no other protection p k an or income and before filing SSDI three years plus out of work. Thank you.
How about multiple stroke and more illness plus a senior citizen oVer 60 years old.. I think this one should qualified for retroactive.
Help is all I ask for, cause I am suffering with my disability I want to be happy and normal like the beautiful world . Plants,animals can thrive in this world so all I ask is for me as well. I’ve been battling this disability all my life and it’s so hard for me to carry on living its gotten even harder so know I’ve come out and announce my problem and I don’t know any or their way to help myself my mind has control over me and not I have control over it.
