Memoranda of Understanding

Memoranda of Understanding (MOUs) explain how two or more agencies will cooperate and interact when their enforcement responsibilities overlap. MOUs involving other federal agencies must be approved by a majority of the Commissioners. The EEOC also has entered in to MOUs with foreign embassies and consulates to enhance cooperation on matters involving employment discrimination against foreign nationals working in the United States.

• EEOC - OFCCP Memorandum Of Understanding Governing the Processing of Charges under Title VII and Executive Order 11246 (November 15, 2011)
  Sets out procedures for OFCCP and EEOC to coordinate investigation of Title VII and E.O. 11246 complaints. Includes procedures for information-sharing and confidentiality, and requires regular interagency coordination meetings. This MOU supersedes the 1999 MOU between EEOC and OFCCP.
• Memorandum of Understanding Between The Equal Employment Opportunity Commission and The Office of Special Counsel for Immigration Related Unfair Employment Practices Date issued 2/3/98
  Prevents overlap in charge filing for national origin discrimination under Title VII and for violations of section 274B of the Immigration and Nationality Act by implementing procedures for referring charges or aspects of charges to the other agency when they fall outside of one agency's jurisdiction.
  
• Memorandum of Understanding Between the National Association of Attorneys General and the Equal Employment Opportunity Commission Date issued 11/12/97
  Sets forth mechanisms for information sharing, participation in joint enforcement initiatives, and cooperation in training, to enhance affirmative enforcement of employment discrimination laws between participating state attorney general offices and the EEOC.
  
• Memorandum of Understanding Between the General Counsel of the National Labor Relations Board and the Equal Employment Opportunity Commission Date issued 11/16/93
  Provides procedures for processing charges pending before either the NLRB or the EEOC involving discrimination by either an employer or a union, where the issues involved may require one agency's interpretation of a statute enforced by the other agency.
