Health

Same sex partners are not eligible as a family member under your enrollment in FEHB. Public Law 104-199, Defense of Marriage Act, states, "the word 'marriage' means only a legal union between one man and one woman as husband and wife, and the word 'spouse' refers only to a person of the opposite sex who is a husband or a wife."

Dental or Vision

Same sex partners are not eligible as a family member under your enrollment in FEDVIP. Public Law 104-199, Defense of Marriage Act, states, " the word 'marriage' means only a legal union between one man and one woman as husband and wife, and the word 'spouse' refers only to a person of the opposite sex who is a husband or a wife."

Life

Per Federal law [Defense of Marriage Act], same sex marriages or civil unions are not recognized by the FEGLI Program. However, you can designate anyone to be the beneficiary of your life insurance by completing SF 2823 "Designation of Beneficiary." Please refer to the FEGLI Handbook more information.

Flexible Spending Accounts

FSAFEDS follows the Defense of Marriage Act PL 104-109. Expenses incurred by your same sex partner are not eligible expenses under FSAFEDS.
